7-C:  AMENDMENT  TO HOUSING  ELEMENT:  Presented  was a continued 
public  hearing on the proposed amendment to the Housing Element, 
continued from March 27, 1990.  Councilmember Katz moved to  hear 
speakers  wishing to address Council regarding this item.  Second 
by Councilmember  Genser.  The  motion was  unanimously approved, 
Councilmembers  Jennings and  Reed absent.   At 7:43  P.M., Mayor 
Zane declared the public hearing opened.  Councilmember  Jennings 
entered the  Council chambers.  Member of  the public Joy Fullmer 
expressed  her  concerns  regarding  singleperson housing.  There 
being  no one else wishing to speak, Mayor Zane closed the public 
hearing at  7:46 P.M.   Mayor Pro  Tempore Finkel  moved to adopt 
Resolution No. 8001(CCS) entitled:   A  RESOLUTION  OF  THE  CITY 
COUNCIL  OF  THE  CITY  OF  SANTA  MONICA  CERTIFYING  THE  FINAL 
ENVIRONMENTAL IMPACT REPORT ON THE HOUSING ELEMENT OF THE GENERAL 
PLAN," reading by title only and waiving further reading thereof. 
Second by Councilmember Genser.  Discussion was held.  The motion 
was approved by the following vote:

Council vote:  Affirmative:  Councilmembers Abdo, Finkel, Genser, 
                             Mayor Zane                           

                  Negative:  Councilmembers Jennings, Katz        

                    Absent:  Councilmember Reed                   

Councilmember Jennings  requested the  record to  reflect that he 
voted  "no"   on  this  item  as  he   does  not  feel  that  the 
Environmental Impact  Report adequately  addresses the  impact of 
the  Ellis Act as it relates to  the Housing Element in light the 
existing  background  of  what  is  happening  with  Santa Monica 
housing.                                                          

Councilmember Katz requested the record to reflect that he  voted 
"no"   on  this  item  for  the  same  reasons  as  expressed  by 
Councilmember Jennings.                                           

Mayor  Pro  Tem  Finkel  moved  to  approve  the proposed Housing 
Element, including the recommended additions contained in Exhibit 
"B", and transmit the document to the State Department of Housing 
and Community  Development  for  final  review  and  comment,  as 
supplemented  by  the  changes  proposed by Councilmember Genser. 
Second by Councilmember  Abdo.  Discussion  was held.   Mayor Pro 
Tem  Finkel  moved  to  amend  the  motion,  to  insert  the word 
"revenue" in front of the word "bond" on line 3 of addition #5 of 
the  supplement.   The  motion   was  accepted  as  friendly   by 
Councilmember Abdo.                                               

Councilmember   Katz    initiated   discussion    regarding   the 
incorporation of family-oriented units, with courts, as a part of 
the normal development of multiple housing units (both apartments 
and  condominiums) and the requirement  that a certain percentage 
of units be barrier-free  (Item 14-J).  Councilmember Katz  moved 
to   amend  the  motion  to  address  family-oriented  units  and 
barrier-free units  as design  standards in  the Zoning Ordinance 
and  to delete  density bonuses  for family-oriented  units.  The 
motion died for lack of a second.                                 

Discussion  was  held.   Councilmember  Katz  moved  to amend the 
motion that staff look  at  making  program  standards  regarding 
families   with   small   children   and  accessibility  for  the 
handicapped, if  feasible  and  also  look  at  them  as  density 
bonuses, and bring back before Council with one, or the other, or 
both, for consideration.                                          

Councilmember Katz moved to amend the motion to include direction 
for  staff  to  investigate  and  program  for  standards  and/or 
analysis of  incentives, including  density bonuses.   The motion 
was  accepted as friendly.   Discussion was held.   Mayor Pro Tem 
Finkel  moved  to  amend  his  motion  to indicate that all staff 
recommended changes,  as included in the  staff report and orally 
presented at the  meeting of March  23rd, are to  be reflected in 
the  motion.  The amendment was accepted as friendly.  Discussion 
was held.                                                         

Mayor Zane moved to amend the motion to add the phrase "and until 
the vacancy rate is 5%, excluding units voluntarily withheld from 
the  market"  to  the  condition  prohibiting   the conversion of 
existing rentals to condominiums or cooperatives until the supply 
of rental housing is equal to the pre-1978 number of units.   The 
motion was accepted as  friendly.   The  motion  as  amended  was 
approved by the following vote:

8-B:  INCLUSIONARY HOUSING PROGRAM:  Presented was a staff report 
and  a public hearing on an  ordinance for introduction and first 
reading amending Santa Monica Municipal Code Sections 9420, 9421, 
9422,  9423,   9424,  9427,  9428,  and   9429  relating  to  the 
Inclusionary Housing Program.  Council asked questions of  staff. 
Councilmember  Jennings moved  to table  this ordinance  until an 
initial environmental assessment is provided by staff.  Second by 
Councilmember Katz.   The  motion  failed,  Councilmembers  Abdo, 
Finkel, and Genser opposed.  Discussion was held.  Council  asked 
questions of staff.                                               
       Staff Report

At  9:20  P.M.,  Mayor  Zane  declared  the  public hearing open. 
Member of the public Mathew Millen spoke in opposition to in-lieu 
fees and  in support  of requiring  inclusionary housing on-site. 
Member  of the public Joy Fullmer expressed her concern.  Members 
of  the  public  Scott  Rutherford,  Jacquie Banks, Nathan Pratt, 
Rosario  Perry, Claudia Harrington, R.  J. Garrett, Evelyn Salem, 
Leah   Mendelsohn,   Carolyn   Guillot,   Tom  Miller,  Selivestr 
Savarovsky,  Ira Sarvian, and Mehrdad Farivar spoke in opposition 
to an increase in fees.  Member of the public Stewart Rubin spoke 
in opposition to an increase in fees and other changes to Program 
12.  Member of  the public Joe  Palazzolo spoke in  opposition to 
the  proposed changes.  Member of the public Cathy Weremiuk spoke 
in support of an increase in percentage of inclusionary units and 
in-lieu  fees.   Member  of  the  public  Tom  Nitti spoke of his 
concerns   with  the  noticing  procedure  with  regard  to  this 
ordinance.   Councilmember  Katz  moved  to  hear  late speakers. 
Second by  Mayor Pro Tempore Finkel.   The motion was unanimously 
approved,  Councilmember  Reed  absent.   Member  of  the  public 
Suzanne Abrescia spoke in  favor  of  an  increase  in  fees  and 
inclusionary units.  Member of the public Norman Teufel spoke  in 
opposition to an increase in fees.                                

At 10:10 P.M.,  Council adjourned for  a short recess.   At 10:35 
P.M.,   Council  reconvened  with  all  members  present,  except 
Councilmember Reed.                                               

Councilmember Abdo moved to close the public hearing and continue 
the   item  to  the  meeting  of   April  17,  1990.   Second  by 
Councilmember Genser.  Discussion  was held.  Councilmember  Katz 
moved a  substitute motion to  continue the item  and re-open the 
public hearing  for members  of the  public who  have not  had an 
opportunity   to  speak.    Second  by   Councilmember  Jennings. 
Discussion  was  held.   The  substitute  motion  failed  by  the 
following vote:

14-B:  CONDOMINIUM TAX:  Presented was the request of Mayor  Zane 
to discuss  increasing the condominium tax.   Mayor Zane moved to 
direct staff to examine increasing the condominium tax and return 
with    recommendations.    Second   by   Councilmember   Genser. 
Discussion was held.  Mayor Zane  moved to amend the motion  that 
this item be considered  the  first  meeting  after  April  17th. 
Second by Mayor Pro  Tempore Finkel.  The motion  was unanimously 
approved, Councilmember Reed absent.                              

14-C:  HOUSING AND PARK FEES:  Presented was the request of Mayor 
Zane  to discuss increasing  housing and park  fees on commercial 
development.  Mayor Zane  moved to direct  staff to examine  this 
issue and  return with recommendations.   Second by Councilmember 
Genser.  Discussion was held.                                     

Councilmember Genser moved  to extend the  meeting to 11:30  P.M. 
Second   by  Councilmember  Katz.   The  motion  was  unanimously 
approved, Councilmember Reed absent.                              

The  motion  was  approved,  Councilmembers  Jennings  and   Katz 
opposed, Councilmember Reed absent.                               

14-D:  CITY COUNCIL RULES  AND PROCEDURES:  The request  of Mayor 
Zane to discuss changes in  City  Council  rules  and  procedures 
directed at  streamlining Council  meetings was  continued to the 
next regular Council meeting.                                     

14-E:   EMERGENCY  NEEDS  DURING  EARTHQUAKES:  Presented was the 
request of  Mayor Zane to discuss  cooperative efforts with other 
California  cities  to  meet  emergency needs during earthquakes. 
Mayor Zane moved  to authorize  the City  Manager to  explore the 
development of cooperative  arrangements with other  communities. 
Second  by Councilmember Katz.  Discussion  was held.  The motion 
was unanimously approved, Councilmember Reed absent.              

14-J:    FAMILY-ORIENTED   HOUSING   UNITS:    The   request   of 
Councilmember   Katz  to  discuss  the  incorporation  of  family 
oriented units, with courts, as a part of the normal  development 
of multiple units (both  apartments  and  condominiums)  and  the 
requirement that  a certain  percentage of  units be barrier-free 
was considered with Item 7-C.
