7-C:   APPEAL/CUP  91-007/RESTAURANT/DANCE  CLUB/1360  3RD STREET 
PROMENADE:   Presented was  the appeal  of a  Planning Commission 
denial  of  CUP  91-007  to  allow  the  expansion of an existing 
restaurant/dance    club   at   1360    3rd   Street   Promenade. 
Applicant/Appellant:   JWS  Investment,  Inc.  Councilmember Zane 
moved to consider this item after Item 10-A due to the absence of 
two councilmembers.   Second by  Mayor Pro  Tempore Genser.   The 
motion  was unanimously approved, Councilmembers Katz and Vazquez 
absent.                                                           
       Staff Report

8-A:  NEW WASTEWATER RATE STRUCTURE:  Presented was an  ordinance 
for  introduction   and  first  reading   amending  Santa  Monica 
Municipal  Code  Sections  7137  and  7143 to incorporate the new 
wastewater rate structure.  Council  asked  questions  of  staff. 
Councilmember Vazquez  reported present  at 7:57  P. M.   At 8:10 
P.M., Mayor Abdo declared the public hearing open.  Member of the 
public  Larry  Beaufait  spoke  in  opposition  to  the  proposed 
ordinance.  Member  of  the  public  Joy  Fullmer  expressed  her 
concerns.  Councilmember Zane moved to hear a late chit for three 
minutes.  Second  by Mayor  Pro Tempore  Genser.  The  motion was 
unanimously approved, Councilmember  Katz absent.  Member  of the 
public Tung-Ying Koo Han spoke  in  opposition  to  the  proposed 
ordinance.  Mayor  Abdo closed  the public  hearing at  8:22 P.M. 
Councilmember Zane moved to approve the proposed wastewater  rate 
structure as described in the  staff  report  and  introduce  for 
first reading an ordinance  entitled:  "AN ORDINANCE OF  THE CITY 
COUNCIL OF THE CITY  OF  SANTA  MONICA  AMENDING  SECTIONS  7137, 
7143A, 7143B, 7143C, AND 7143D OF THE SANTA MONICA MUNICIPAL CODE 
RELATING TO  SEWER SERVICE  CHARGES," reading  by title  only and 
waiving further reading thereof.  Second by Councilmember  Olsen. 
Discussion  was held.  The  motion was approved  by the following

9-A:  CLOSED SESSION:  Held at end of meeting.                    

10-A:  LOCAL COASTAL PROGRAM  PUBLIC HEARING:  Presented was  the 
public hearing on  the proposed  Local Coastal  Program.  Council 
asked questions of staff.  At 9:00 P.M., Mayor Abdo declared  the 
public  hearing open.  Member of the public Joy Fullmer expressed 
her concerns.  Member of the public Kathleen Schwallie  expressed 
concern  that the LCP does not  reflect current conditions in the 
coastal zone  and suggested  amendments.  Members  of the  public 
Sarah Jaquith and  Sharon  Gilpin  spoke  in  opposition  to  the 
inclusion of  Nes Park  in the  LCP.  Member  of the public Julie 
Lopez-Dad  spoke in support of the  LCP with amendments and urged 
Council to protect  housing.  Members of  the public Marx  Ayres, 
Camille Shaheen, and  Bruria  Finkel  spoke  in  support  of  the 
inclusion of Nes Park in the LCP.                                 
       Staff Report

At  9:57  P.M.,  Council  adjourned  for a short recess.  Council 
reconvened  at 10:38 P.M. with all members present, Councilmember 
Katz absent.                                                      

10-A:  LOCAL COASTAL  PROGRAM PUBLIC HEARING  (RESUMED):  Members 
of the public Bill Tunberg, Tom Etherton, Adam Finkel, Paul Leaf, 
Robert Berman, Pam O'Conner,  Sandra Star, and Carol  Wells spoke 
in  support of the inclusion  of Nes Park in  the LCP.  Member of 
the public Harry Shearer spoke in opposition to the inclusion  of 
Nes Park in the LCP.  Member of the public George Rosenthal spoke 
in opposition to the R2B  zone and expressed concern with  height 
limitations  on certain  lots and  the RVC  zone.  Member  of the 
public Deborah Rosenthal requested mitigation controls in the RVC 
zone.   Member of  the public  Roger Genser  spoke in  support of 
protecting  housing  along   the  Coastal  Zone   and  encouraged 
affordable  housing, and spoke in support of the inclusion of Nes 
Park in  the LCP.   Members of  the public  Bob Gabriel  and John 
Bodin spoke in opposition to the inclusion of Nes Park in the LCP 
and in opposition to placement  of  statues  in  Palisades  Park. 
Member  of  the  public  Eric  Siss  stated  his concurrence with 
Kathleen Schwallie, above,  and  stated  his  opposition  to  the 
inclusion of Nes  Park in the  LCP.  Councilmember Zane  moved to 
extend the meeting  to 12:00  Midnight.  Second  by Councilmember 
Vazquez.  The motion was unanimously approved, Councilmember Katz 
absent.   Member of the  public Alex Man  suggested developing an 
easement in the canyon at the foot of Inspiration Point in  order 
to  obtain beach access at the northern end of the park.  Members 
of  the  public  Barbara  Robertson  and  Ian Robertson discussed 
problems  being experienced  with the  Jonathan Club  parking lot 
adjacent to  their property.   Member of  the public  Fred Harris 
requested mitigation  controls in  the RVC  zone.  Member  of the 
public Merle  Schipper spoke in  support of the  inclusion of Nes 
Park in the LCP.  Mayor  Abdo closed the public hearing  at 11:20 
P.M.   Discussion was held.  Councilmember Zane moved to consider 
the Public  Hearing action  at the  meeting of  October 8,  1991. 
Second  by Councilmember Vazquez.  The motion was approved by the

7-C:   APPEAL/CUP  91-007/RESTAURANT/DANCE  CLUB/1360  3RD STREET 
PROMENADE (RESUMED):   Applicant/Appellant Randy  Larscheid spoke 
in support of the appeal.   Member of the public Merritt  Coleman 
spoke in support  of the  appeal and  expressed concern  with the 
integrity of the process.  Councilmember Olsen moved to deny  the 
appeal  and uphold the  Planning Commission's denial  of the CUP. 
Second   by   Councilmember    Zane.    Discussion   was    held. 
Councilmember Olsen moved to amend  his  motion  to  include  the 
findings set forth in the Planning Commission staff report  dated 
May  8,  1991.     The  amendment   was  accepted   as  friendly. 
Discussion was held.   The motion was  approved by the  following

Councilmember Holbrook moved to extend the meeting to 12:30  A.M. 
Second by Mayor  Abdo.   The  motion  was  unanimously  approved, 
Councilmember Katz absent.                                        

13-A:  F.E.  HARRIS/STANDARDS/LOCAL COASTAL  PLAN:  F.  E. Harris 
presented his request to address Council regarding adoption of an 
interim ordinance that would incorporate all the standards of the 
new  Local Coastal Plan for lots of 40' or less in width.  Member 
of the  public Diane  Caughey spoke  in support  of the  proposed 
interim ordinance.  Discussion was held.  No action taken.        

14-B:   COMMISSION  APPOINTMENT/CHARTER  REVIEW  COMMISSION:  The 
request  of Councilmember Vazquez to discuss the appointment of a 
member  to  the  Charter  Review  Commission  was  continued to a 
Council meeting  after  October  16,  1991,  at  the  request  of 
Councilmember Vazquez.                                            

15.  PUBLIC INPUT:   Member of the  public Joy Fullmer  expressed 
her concerns regarding a staff  report.   Member  of  the  public 
Rosemarie Bowman expressed concern that the Olive Stone Day  Care 
Center for  Senior  Citizens  is  being  moved  and  sharing  the 
Altzheimer facility on Wilshire Boulevard.                        

9-A.  CLOSED SESSION:  At 12:12 A.M., Council adjourned to Closed 
Session for  the purpose of discussing  pending litigation in the 
case of Jones v. City of Santa Monica, Los Angeles Superior Court 
Case No. WEC 100365.                                              

Council reconvened at 12:35 P.M.  No action was taken
