SUBJECT:  Resolution to Set a Public Hearing for June  11,  1991,
          for  the Confirmation of Gutter Construction and Street
          Resurfacing  Assessments  on  Pico  Boulevard   between
          Twenty Eighth Street and the East City Limits

Introduction

This report recommends that the City Council set a public hearing
for  June  11,  1991,  to hear protests regarding the work and to
confirm  the  assessments  for  gutter  construction  and  street
resurfacing  on  Pico Boulevard between Twenty  Eighth Street and
the East City limits, all within the City of Santa Monica.

Background

The reconstruction of Pico Boulevard between Twenty Eighth Street
and the East City limits was approved by the City Council in
FY 1985-86 as a Federal Aid Urban  capital  improvement  project.
This  project  experienced  delays in the design and construction
phase and a delay period of approximately 18 months in  obtaining
Caltrans   approval  to  advertise.   The  project  included  the
construction of concrete  bus  pads,  curbs,  gutters,  and  curb
ramps,  and  asphalt  concrete  resurfacing  and asphalt concrete
reconstruction in certain areas of the city.

Only commercial and industrial property owners will be  assessed.
The  assessed  costs are:  1) $9.50 per lineal foot which is 100%
of the cost of gutter construction, and 2) $7.50 per lineal  foot
which  is  50%  of  the cost of the street resurfacing. The total
assessment is $17.00 per lineal foot when  construction  of  both
items  is necessary in front of a property.  Property owners were
notified in accordance with State law and the public hearing  was
held  February  23,  1988.  After closing the public hearing, the
Council ordered the work to commence.

The work was completed, and commercial  and  industrial  property
owner  assessments are now due.   A public hearing to confirm the
assessments  must  be  held  pursuant  to  Section  5882  of  the
California  Streets  and  Highways Code.  The attached resolution
sets the public  hearing  for  June  11,  1991.   Commercial  and
industrial  property  owners  will  be  notified  of the date and
assessment amount fifteen days prior to the public hearing.

Budget/Financial Impact

Approximately $34,823.63 will be generated  from  property  owner
assessments.   Revenue  will  be deposited in Account No. 01-500-
401-00000-0124-10000, "Street Resurfacing Assessment".

Recommendation

It is recommended  that  the  City  Council  adopt  the  attached
resolution setting a public hearing for June 11, 1991, to confirm
the  assessments  for  gutter  and  street  resurfacing  on   the
abovementioned streets.

              A RESOLUTION OF THE CITY COUNCIL  OF  THE
              CITY  OF  SANTA  MONICA  SETTING A PUBLIC
              HEARING FOR JUNE 11, 1991,  TO  HEAR  ANY
              PROTESTS    OR    OBJECTIONS    TO    THE
              CONFIRMATION OF  ASSESSMENTS  FOR  GUTTER
              INSTALLATION  AND  STREET  RESURFACING ON
              PICO  BOULEVARD  BETWEEN  TWENTY   EIGHTH
              STREET AND THE EAST CITY LIMITS

          THE CITY COUNCIL OF  THE  CITY  OF  SANTA  MONICA  DOES
HEREBY RESOLVE AS FOLLOWS:

          SECTION 1.  The Superintendent of Streets will  file  a
report  of  work  pursuant  to  Section  5882  of the Streets and
Highways Code  of  the  State  of  California,  relating  to  the
construction  of certain improvements completed on Pico Boulevard
between Twenty Eighth Street and the East City limits, all within
the City of Santa Monica.

          SECTION 2.  Pursuant to Section 5870 et  seq.  of  said
Code,  the City Council does hereby order and declare that on the
11th of June, 1991, at 7:30 p.m., in the City Council Chambers of
City  Hall,  it  will  hear  and  pass  upon  the  report  by the
Superintendent of Streets, of the cost of  construction  together
with  any  objections or protests, if any, which may be raised by
any property owner liable to be assessed for  the  cost  of  such
construction and any other interested persons.

          SECTION 3.  All  protests  or  objections  must  be  in
writing  and  filed with the City Clerk on or before the time set
for the hearing of the protests and objections.

          SECTION 4.  The Superintendent  of  Streets  is  hereby
directed  to  mail  notices, in the manner and form prescribed by
law, of the cost of construction and  of  the  adoption  of  this
Resolution  to  all  persons owning commercial or industrial real
property in the hereinbefore described assessment district  whose
names  and addresses appear on the last equalized assessment roll
for the City taxes or as known to the City Clerk.

          SECTION  5.   The  City  Clerk  shall  certify  to  the
adoption  of this Resolution, and thenceforth and thereafter, the
same shall be in full force and effect.
