SUBJECT:  Resolution to Set a Public Hearing for August 13,  1991
          for the Confirmation  of Assessment  of Costs  for Tree
          Planting on Wilshire Boulevard between Ocean Avenue and
          Centinela Avenue

Introduction

This report recommends that the City Council set a public hearing
for  August  13,  1991,  to  hear  protests  regarding  the  work
completed and  to  confirm  the  assessment  of  costs  for  tree
planting on Wilshire Boulevard between Ocean Avenue and Centinela
Avenue.

Background

On May 10,  1988, the City  Council approved the  formation of an
assessment  district  for  tree  planting  for Wilshire Boulevard
between Ocean  Avenue  and  Centinela  Avenue.  Drought  tolerant
Mexican Fan Palms were planted on both the north and south  sides
of  the street in accordance with  the city's guidelines on water
conservation.

Commercial and industrial property owners only will be  assessed.
The assessments will be $3.00  per   front   footage   for   tree
planting.

Property owners were  notified in accordance  with State law  and
the public  hearing was held on May  10, 1988.  After closing the
public hearing, the Council ordered the work to commence.

The  work  has  been  completed  and  commercial  and  industrial
property owner assessments are now  due.   A  public  hearing  to
confirm the assessments must be held pursuant to Section 5882  of
the  California   Streets  and   Highways  Code.    The  attached
resolution  sets  the  public   hearing  for  August  13,   1991.
Commercial and industrial property owners will be notified of the
date  and  assessment  amount  fifteen  days  prior to the public
hearing.  A list of  property  owners  and  assessments  will  be
available to Council at the time of the public hearing.

Budget/Financial Impact

Approximately $60,389.46 will be generated from property  owner's
assessments.   Revenue  will  be   deposited   in   Account   No.
01-500-401-00000-0177-10000,   "Tree    Planting",   to    offset
expenditures which  were  incurred  in  the  completion  of  this
project   Any  unpaid  assessments  will  be  put  on the 1992-93
property tax rolls by the Los Angeles County Assessor's office.

Recommendation

It  is  recommended  that  the  City  Council  adopt the attached
resolution setting a public  hearing  for  August  13,  1991,  to
confirm the  assessment of  costs for  tree planting  on Wilshire
Boulevard between Ocean Avenue and Centinela Avenue.

          A RESOLUTION OF THE CITY COUNCIL OF THE CITY
          OF SANTA MONICA SETTING A PUBLIC HEARING FOR
          AUGUST 13, 1991 TO HEAR ANY PROTESTS OR
          OBJECTIONS TO THE CONFIRMATION OF ASSESSMENT
          OF COSTS FOR TREE PLANTING ON WILSHIRE
          BOULEVARD BETWEEN OCEAN AVENUE AND CENTINELA
          AVENUE

          THE  CITY  COUNCIL  OF  THE  CITY  OF SANTA MONICA DOES
HEREBY RESOLVE AS FOLLOWS:

          SECTION 1.   The Superintendent of Streets will file  a
report of work pursuant  to  Section  5882  of  the  Streets  and
Highways Code of  the State of  California, relating to  the tree
planting completed on Wilshire Boulevard between Ocean Avenue and
Centinela Avenue within the City of Santa Monica.

          SECTION 2.   Pursuant to  Section 5870 et seq.  of said
Code,  the City Council does hereby order and declare that on the
13th  day  of  August  1991,  at  7:30  p.m., in the City Council
Chambers  of City Hall, it will hear  and pass upon the report by
the  Superintendent  of  Streets,  of  the  cost of tree planting
together with  any objections or  protests, if any,  which may be
raised by any property owner  liable to be assessed for  the cost
of such tree planting and any other interested persons.

          SECTION  3.    All  protests  or  objections must be in
writing  and filed with the City Clerk  on or before the time set
for the hearing of the protests and objections.

          SECTION 4.    The Superintendent  of Streets  is hereby
directed to  mail notices, in  the manner and  form prescribed by
law, of the  cost of tree  planting and of  the adoption of  this
Resolution to all  persons owning  commercial or  industrial real
property in the hereinbefore described assessment district  whose
names  and addresses appear on the last equalized assessment roll
for the City taxes or as known to the City Clerk.

          SECTION  5.    The  City  Clerk  shall  certify  to the
adoption  of this Resolution, and thenceforth and thereafter, the
same shall be in full force and effect.
