SUBJECT: Recommendation to Hold a Public Hearing for the Confirmation of
Assessment of Costs for Street Resurfacing on Pico Boulevard from
Twentieth Street to Twenty Eighth Street Completed With the 1990-91
Street Resurfacing Program
Introduction
This report recommends that City Council hold a public hearing to hear protests
regarding the completed street resurfacing work and to confirm the assessment
of costs for street resurfacing on Pico Boulevard from Twentieth Street to
Twenty Eighth Street. These improvements were completed with the 1990-91
street resurfacing program.
Background
On April 14, 1992 City Council held a public hearing to confirm the assessment
of costs for the FY 1990-91 street resurfacing program. Some property owners
on Pico Boulevard from Twentieth Street to Twenty Eighth Street did not receive
the Notice of Public Hearing because of a clerical error.
A public hearing to confirm the assessment of costs must be held pursuant to
Section 5882 of the California Streets and Highways Code. On April 28, 1992,
City Council set the public hearing date for the confirmation of the assessment
amounts for May 26, 1992. All affected property owners were notified by mail
on May 8, 1992 of the public hearing date and the assessment amount. A list of
property owners and assessment amounts will be available to City Council at
the time of the public hearing.
Residential properties are not assessed for street resurfacing. Commercial and
industrial property owners will be assessed the full cost for the street
resurfacing at $9.00 per lineal foot. The assessments are designed so that
each commercial and industrial property owner will pay the same unit cost
regardless of the width of the street on which their property fronts.
Consistent with the present policy for assessing commercial and industrial
properties, this assessment will be a cash assessment and no bonds will be
issued. For a commercial or industrial property owner with a 50 foot lot, the
typical assessment is $450.00 for street resurfacing.
Budget/Financial Impact
It is calculated that approximately $11,970 will be generated from property
owner assessments for street resurfacing. Revenues will be deposited in
Account No. 01-500-401-00000-0124-10000, "Street Resurfacing Assessment". Any
unpaid assessments will be put on the 1992-93 property tax roll by the Los
Angeles County Assessor's office.
Recommendation
It is recommended that City Council:
1. Open the public hearing;
2. Close the public hearing; and
3. Acknowledge any protest and adopt the attached resolution confirming
the assessment of costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
APPROVING THE ASSESSMENT DIAGRAM AND CONFIRMING ASSESSMENT
OF COSTS FOR STREET RESURFACING ON PICO BOULEVARD FROM
TWENTIETH STREET TO TWENTY EIGHTH STREET COMPLETED WITH THE
1990-91 STREET RESURFACING PROGRAM
WHEREAS, the City of Santa Monica, pursuant to Section 5100
et seq. of the Streets and Highways Code, commenced proceedings to
resurface Pico Boulevard from Twentieth Street to Twenty Eighth
Street; and
WHEREAS, the proceeding is more fully described in the
Resolution of Intention adopted by City Council on May 28, 1991, being
Resolution Number 8229 (CCS); and
WHEREAS, the contract for the above-described work has been
fulfilled to the satisfaction of the Superintendent of Streets; and
WHEREAS, the Superintendent of Streets has made an
assessment to cover sum due for the work performed and specified in
the contract; and
WHEREAS, the assessment has been filed with the City Clerk;
and
WHEREAS, the City Clerk gave the notice required by
Sections 5362 and 5363 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by the
City Clerk, the City Council of the City of Santa Monica heard and
passed any and all objections, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. All objections, appeals, and protests of every
kind and nature be to the confirmation of assessment of costs, and the
same are hereby, overruled and denied.
SECTION 2. The diagram of property, affected and benefited
by street resurfacing on:
Pico Boulevard - from Twentieth Street to Twenty Eighth Street
in the City of Santa Monica, as more fully described in Resolution
Number 8229 (CCS) and therein declared to be the property to be
assessed to pay the expense of the improvements, is approved and the
City Clerk is directed to execute the certificate on the diagram
certifying such approval and to deliver the diagram to the
Superintendent of Streets.
SECTION 3. The assessment for resurfacing Pico Boulevard
from Twentieth Street to Twenty Eighth Street as more fully described
in Resolution Number 8229 (CCS), be, and the same hereby is, confirmed
and approved.
SECTION 4. The Superintendent of Streets shall forthwith
attach a warrant to said assessment bearing the date of this
confirmation.
SECTION 5. The assessment roll, warrant, and diagram shall
be recorded in the Office of the Superintendent of Streets, and
immediately thereafter the City Clerk shall file a copy of the
assessment diagram in the Office of the County Recorder, and
thereafter shall record in said Office of the County Recorder, a
Notice of Assessment, all in the manner and form prescribed by Section
3114 of the Streets and Highways Code of the State of California.
SECTION 6. Assessments not paid to the City within the
specified time shall be sent to the Los Angeles County Assessor to
collect such assessments upon the tax roll which general taxes are
collected.
SECTION 7. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter, the same shall be in
full force and effect.
