SUBJECT: Recommendation to Accept Petitions, Approve Installation of
Streetlights and the Replacement of Deteriorated
Streetlights, and Set a Public Hearing for July 28, 1992
INTRODUCTION
This report requests that City Council accept petitions requesting the
installation of streetlights on:
ARIZONA AVENUE - From Franklin Street to Centinela Avenue;
CALIFORNIA AVENUE - From Twenty Fifth St. to Twenty Sixth St.;
THIRTIETH STREET - From Pearl Street to Ocean Park Boulevard; and
YALE STREET - From Wilshire Boulevard to Washington Avenue
The report also recommends that City Council approve the replacement of
deteriorated streetlights on San Vicente Boulevard from Fourth Street
to Seventh Street and adopt the attached Resolution of Intention which
sets a public hearing for July 28, 1992 which declares the City's
intention to assess property owners for costs and issue bonds as
security for unpaid assessments for those streets.
BACKGROUND
Procedure for Residential Streetlight Installation
In accordance with City policy, citizens desiring streetlights
installed on their block circulate a petition and information sheet
prepared by City staff. The information sheet briefly explains the
process and how each property owner will be assessed. Property owners
are assessed for streetlighting based on the property size.
Residential owners are assessed 50% of their front footage and for
corner lots, 20% of their side footage costs, with the City paying the
remaining 50% and 80%, respectively. Commercial property owners are
assessed 100% of their front footage and 40% of the side footage costs,
with the City paying the remaining 60% of the side footage costs.
Successful streetlight petitions contain the signatures of a minimum of
sixty percent (60%) of each block's residents.
Petitions are then presented to City Council and a public hearing to
hear protests is set. After the public hearing the City Council
orders the work to begin. The project is competitively bid by private
contractors, a contract is awarded by City Council to the lowest
responsible bidder and bonds are authorized to be sold. Owners may pay
for the improvements over ten (10) years at an 8.8% interest rate..
The Petitions for Streetlight Installation
At the request of residents, staff prepared streetlight petitions for:
ARIZONA AVENUE - From Franklin Street to Centinela Avenue
CALIFORNIA AVENUE - From Twenty Fifth St. to Twenty Sixth St.
THIRTIETH STREET - From Pearl Street to Ocean Park Boulevard
YALE STREET - From Wilshire Boulevard to Washington Avenue
A minimum of sixty percent (60%) of residents of these streets
requested installation of streetlights. Rent Control staff has
reviewed the petitions and determined that they conform with Rent
Control Regulations for pass-through of assessments.
A meeting between staff and petitioners was held on April 1, 1992, to
discuss the location of the streetlights, types of streetlights
(decorative vs. standard) available and the approximate costs to the
property owners. Only the property owners on Yale Street requested the
more expensive decorative streetlights for their block. Hence, their
share of assessments will be higher than the other blocks that
requested the standard streetlights. The City pays only 50% of the
cost for the standard streetlights and property owners choosing the
decorative streetlights will be required to pay the difference between
the standard streetlighting and the decorative streetlighting.
Staff is presenting these petitions to City Council for acceptance and
requesting that a public hearing be set for July 28, 1992, to hear
protests, if any, and approve the establishment of an assessment
district in accordance with the Improvement Act of 1911 of the Streets
and Highways Code. Notices will be posted and property owners and
residents will be notified by mail 15 days in advance of the public
hearing, of the time and place of the public hearing.
Copies of the signed petitions and a map of the proposed assessment
district will be available in the Council Chambers at the time of the
Public Hearing.
The Proposed Streetlight Replacement on San Vicente Boulevard
The Capital Infrastructure Needs Assessment Study, completed in
February of 1984 and presented to City Council, recommended that
deteriorated and energy-inefficient streetlights be replaced at various
locations throughout the City. Several streets needing circuit and
pole replacement were identified in the study and staff has determined
that the streetlight system on San Vicente Boulevard from Fourth Street
to Seventh Street is in most need of replacement. This determination
was based on the number of actual repairs made and the number of
repairs planned to maintain the 72 year old, badly deteriorated system
on San Vicente Boulevard.
Staff held a meeting with property owners and residents on February 20,
1992 and they were in support of this project. Assessments for San
Vicente Boulevard are proposed to be the same as those on Yale Street,
since decorative streetlights will be installed. Staff is recommending
that streetlights be installed on these streets for the safety and
convenience of the residents. Notices will be posted and property
owners and residents will be notified by mail 15 days in advance of the
public hearing, of the time and place of the public hearing.
The City's portion of the assessment costs will be financed out of the
annual streetlighting Capital Improvement Project account. A grant
program will be available for low to moderate income households.
BUDGET/FINANCIAL IMPACT
The total estimated cost for the project is $220,000.00. The total
estimated assessment is $26.80 per foot of property frontage. The
estimated prorated assessment for residential property owners is $13.40
per front foot. Property owners on Yale Street and San Vicente
Boulevard will be assessed approximately $17 per front foot.
City Council previously held public hearings and approved the
construction of streetlighting on Twenty Fourth Street between Wilshire
Boulevard and Arizona Avenue and Sixth Street between Santa Monica
Boulevard and Arizona Avenue and these two blocks in addition to the
blocks mentioned in this report, will be combined into a single
construction contract.
The estimate for a typical residential property owner's share is
approximately $690 for a 50 foot lot frontage with the City's share
being an equal amount. Yale Street and San Vicente Boulevard property
owners will pay approximately $850 for a 50 foot lot and the City's
cost would be $690. The proposed breakdown is as follows:
Estimated property owner assessments $119,300.00
Estimated City contribution 100,700.00
Total project estimate $220,000.00
Appropriation authority for the City's contribution is available in CIP
Account No. 01-770-453-25491-8917-99155, "New Streetlight Systems" in
the amount of $68,800.00, for the new streetlights and account no.
01-770-453-20092-8900-99154, "Streetlight Circuit Replacement" in the
amount of $46,100.00, for the streetlight replacements. The remaining
costs for the project will be paid through property owner assessments.
Assessments will be paid upon completion of the work and will be held
in a trust account #80-000-000-00000-9750-04289 pending payment to the
contractor who installs the lights. Bonds are then issued for any
unpaid assessments. Bond proceeds are paid to the Contractor and the
property owner(s) then pay off the bond holder(s) over time.
RECOMMENDATION
It is recommended that City Council:
1. Accept the streetlight petitions for the installation of
streetlights on:
Arizona Avenue - from Franklin Street to Centinela
Avenue;
California Avenue - from Twenty fifth Street to Twenty
Sixth Street;
Thirtieth Street - from Pearl Street to Ocean Park
Boulevard, and
Yale Street - from Wilshire Boulevard to Washington
Avenue.
2. Approve the replacement of streetlights on:
San Vicente Boulevard - from Fourth Street to Seventh Street
3. Adopt a Resolution of Intention which sets a public hearing
for July 28, 1992, and declares the City's intention to assess
property owners for costs and issue bonds as security for unpaid
assessments.

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC HEARING ON JULY
28, 1992 FOR THE PURPOSE OF DETERMINING WHETHER OR
NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
CONSTRUCTION OF STREETLIGHTING AND DECLARING ITS
INTENTION TO CONSTRUCT STREETLIGHTING, REPLACE
DETERIORATED STREETLIGHTS AND APPURTENANT WORK ON
VARIOUS CITY STREETS AS SHOWN ON CITY DRAWING NO.
10042 WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City council of the City of Santa Monica proposes
to initiate proceedings under the Improvement Act of 1911 for
streetlighting improvements; and
WHEREAS, Section 19 of Article XVI of the California
Constitution provides that certain specified debt limitation and
majority protest provisions shall not apply, if after the giving of
such reasonable notice by publication and posting and the holding of
such public hearing as the City Council of the City of Santa Monica
shall have prescribed, the City Council by no less than four-fifths
vote of all members thereof finds and determines that the public
convenience and necessity require the proposed improvements to be made;
and
WHEREAS, Streets and Highways Code Section 2804 provides that
the "Special Assessment, Investigation, Limitation and Majority Protest
Act of 1931" shall not apply to any proceeding otherwise subject
thereto when said improvement proceeding is by a charter city and said
city has complied with the provisions of Section 19 of the Article XVI
of the California Constitution; and
WHEREAS, the City of Santa Monica is a charter city of the
State of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council proposes to initiate proceedings
for the installation of streetlighting and appurtenant work on the
streets shown on City Drawing No. 10042 and generally known as, Phase
VI - Construction of High Pressure Sodium streetlight systems on :
ARIZONA AVENUE - from Franklin Street to Centinela Avenue;
CALIFORNIA AVENUE - from Twenty Fifth St. to Twenty Sixth St.;
THIRTIETH STREET - from Pearl Street to Ocean Park Boulevard;
YALE STREET - from Wilshire Boulevard to Washington Avenue,
all within the City of Santa Monica.
SECTION 2. The City Council proposes to initiate proceedings
for the replacement of deteriorated streetlighting and appurtenant work
on the street shown on City Drawings No. 10042 and generally known as:
SAN VICENTE BOULEVARD - from a portion of Third St. to Seventh St.
SECTION 3. The total estimated cost of the proposed
improvement is Two Hundred Twenty Thousand Dollars ($220,000).
SECTION 4. Improvements shall be conducted under the
Improvement Act of 1911, which is Division 7 of the Streets and
Highways Code of the State of California.
SECTION 5. The proposed work or improvement in the opinion of
City Council of the City of Santa Monica is of more than local or
ordinary public benefit, and City Council hereby proposes that the
district in the City of Santa Monica to be benefited by said work or
improvement and to be assessed to pay one-half of the cost and expense
thereof, is shown upon a certain map indicating the exterior boundary
thereof, which said Drawing No. 10042-A is on file in the Office of the
City Engineer. The map hereby is referred to and shall govern for all
details as to the extent of said assessment district. The assessment
district includes in general the lots and parcels described in Section
1 above but reference hereby is made to said Drawing for all details as
to the extent of said assessment district and for any variation between
the last mentioned general description and the extent of said
assessment district as shown on said map. All public streets or
alleys, or portions thereof, hereby are excepted from said district.
SECTION 6. The City will pay a portion of the cost and
expenses of the work described herein, and the City Controller is
authorized and directed to pay the same immediately upon confirmation
of the assessment by City Council.
SECTION 7. Serial bonds bearing interest at the rate of 8.8%
per annum shall be issued to represent each assessment of One Hundred
Fifty Dollars ($150.00) or more remaining unpaid for thirty (30) days
after the recording of the warrant. Said serial bonds shall extend
over a period ending nine (9) years from the second day of January next
succeeding the next September 1st following their date. Payments on
the principal of unpaid assessments and interest shall be made by
property owners to the City Treasurer and the same shall be disbursed
by him or as provided in the "Improvement Act of 1911" hereinafter
referred to. In accordance with Streets and Highways Code
Section 6442, the first two percent delinquency penalty authorized by
such section shall be retained by the City Controller as the cost of
servicing the delinquency.
SECTION 8. Notice is hereby given that on Tuesday, the 28th
day of July, 1992, at 7:30 p.m., in the City Council Chambers located
in City Hall, 1685 Main Street, Santa Monica, California, there shall
be a public hearing before said City Council for the purpose of
determining whether the public convenience and necessity require the
above-described improvement and for the purpose of allowing any and all
persons having any objections to the proposed work or improvement to
appear and show cause why the said proposed work or improvement should
not be carried out in accordance with said Resolution of Intention.

SECTION 9. The City Clerk shall give notice of the hearing by
posting a copy of this Resolution in the manner described by Streets
and Highways Code Section 5065 and by publication as hereinafter
provided. Any interested person may protest against the proposed
improvement in writing filed with the City Clerk at any time not later
than the hour set for the hearing in the manner provided by Streets and
Highways Code Section 5220.
SECTION 10. The Superintendent of Streets shall cause to be
conspicuously posted along the line of said contemplated work or
improvement and also along all the open streets within the said
district, notice of the passage of this Resolution of Intention in the
manner and form prescribed by law.
The City Clerk hereby is directed to mail notices, in the
manner and form prescribed by law, of the adoption of this Resolution
to all persons owning real property in the hereinbefore described
assessment district, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known to the City
Clerk.
SECTION 11. The City Clerk hereby is directed to publish this
Resolution in The Outlook on two successive dates, the first
publication is to be made not less than fifteen (15) days prior to the
date of the above public hearing.
SECTION 12. Pursuant to Public contract Code Section 20433,
the City Council hereby states that the property owners may not
contract for the improvements and that the City shall be responsible
for letting and administering the construction contract for this
district.
SECTION 13. The City hereby declares that Community
Development block Grant funds may be applied for payment of assessments
on property owned or resided in by low to moderate income households.
SECTION 14. The City Clerk shall certify to the adoption of
this Resolution, and thereafter the same shall be in full force and
effect.
