SUBJECT:  Certification  of  Statement  of  Official  Action  for
          Appeal  of  Conditional  Use Permit 91-041, 625 Montana
          Avenue.

INTRODUCTION

This  report  transmits  for  City  Council   certification   the
Statement  of  Official Action for the appeal of the above listed
Conditional Use Permit to allow the upgrade from an existing Type
20  (Off-Sale  Beer  and  Wine)  alcohol  license  to  a  Type 21
(Off-Sale General) alcohol license for an  existing  retail  wine
sales establishment, Montana Wine Company.

BUDGET/FINANCIAL IMPACT

This recommendation will have no budget or financial impact.

RECOMMENDATION

It is respectfully recommended that the City Council approve  the
attached Statement of Official Action which contains findings and
conditions of approval for Conditional Use Permit 91-041.
