6-E: DEVELOPMENT STANDARDS/R3 AND R3A: Council asked questions
of staff. Discussion was held. Councilmember Holbrook moved to
adopt Ordinance No. 1700(CCS) entitled: "AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING PART 9.04.08.65
TO THE SANTA MONICA MUNICIPAL CODE REGARDING THE BR BOULEVARD
RESIDENTIAL R3 OVERLAY DISTRICT," and Ordinance No. 1701(CCS)
entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA AMENDING OFFICIAL DISTRICTING MAP," reading by title only
and waiving further reading thereof. Second by Councilmember

7-A: APPEAL/DEVELOPMENT REVIEW 92-002/CONVERSION OF OFFICE TO
MEDICAL/1919 SANTA MONICA BOULEVARD: The appeal of Planning
Commission approval of Development Review 92-002 to allow the
conversion of a 16,000 sq. ft. existing general office space to
medical office use at 1919 Santa Monica Boulevard was continued
to the meeting of September 21, 1993, at the request of the
applicant/appellant.

7-B: APPEAL/CUP 92-021/VTTM 51335/CONDOMINIUMS/860 THIRD STREET:

Presented was the appeal of Conditional Use Permit (CUP) 92-021
and Vesting Tentative Tract Map (VTTM) 51335 for a 12-unit
condominium project at 860 Third Street. Applicant:1255 Federal
Avenue Partnership. Appellant: Caroline Vincent, William
Pirtle, Sheri and Ken Kagann. Council asked questions of staff.
Sheri Redfern Kagann and William Pirtle, representing the
appellant, spoke in support of the appeal and in opposition to
the project. Council asked questions of the appellant. Mehrdad
Amanat and Mehrdad Farivar, representing the applicant, spoke in
support of the project and in opposition to the appeal. Council
asked questions of the applicant. Members of the public Dick
Kingery, Elena Christova, Lester Melk, Ken Kagann, Eleanor Brady,
Arne Nordh, Rory Brice, and Arthur Phillips spoke in support of
the appeal and in opposition to the project. Member of the
public Joy Fullmer expressed her concerns. Rebuttals were
presented. Council asked questions of staff. Councilmember
Genser moved to uphold the appeal and deny the application and
direct staff to prepare findings based on the issues of
neighborhood compatibility and the appropriateness of utilizing
the Ellis Act. Second by Councilmember Olsen. Council asked
questions of staff. Discussion was held. Councilmember Olsen
moved to amend the motion to include the fact that the two
buildings are held under the same business license. The motion
was accepted as friendly. Discussion was held. The motion was
approved by the following vote:
Council vote: Affirmative: Councilmembers Rosenstein, Olsen,
Greenberg, Genser, Vazquez, Mayor

Councilmember Holbrook requested that the record reflect that he
voted "no" on this item because the Planning Commission decided
that these are two separate buildings and he is very concerned
with the City's liability. The City agrees that there are two
lots, the County Assessor and Recorder agree that there are two
lots, and the buildings have separate utilities, etc.
Councilmember Greenberg requested that the record reflect that
she had a lot of difficulty supporting this motion as there are
some questions which were not answered to her satisfaction.
Council adjourned to Closed Session at 10:00 P.M. Council
reconvened at 11:00 P.M. with Councilmembers Olsen, Vazquez and
Genser present. Mayor Pro Tempore Vazquez adjourned the meeting
for lack of a quorum and motion to continue meeting past 11:00
P.M.
By virtue of the above, the following Items were continued to

8-A: OFF-STREET PARKING REQUIREMENTS: The ordinance for second
reading and adoption amending Santa Monica Municipal Code Section
9.04.10.08 regarding off-street parking requirements (Text

to the meeting of September 14, 1993.
14-B: COUNCIL PROCEDURES: The request of Councilmember
Rosenstein to discuss consideration of Council procedures was
continued to the meeting of September 14, 1993.
