CITY COUNCIL MINUTES
JULY 19, 1994
An adjourned meeting of the Santa Monica City Council was
called to order by Mayor Abdo at 6:15 P.M. on Tuesday, July 19,
1994, in the Council Chambers.
CLOSED SESSION: At 6:15 P.M., Council adjourned to Closed
Session to discuss the public employee evaluation of the City
Manager.
At 7:25 P.M., Council reconvened with all members present.

Councilmember Holbrook led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.
Councilmember Olsen withdrew his request to add late Item 14-A
to the agenda.
4-A: COMMENDATION/STERLING COMMUNITY SERVICE FOUNDATION:
Mayor Abdo presented a commendation recognizing the
accomplishments of the Sterling Community Service Foundation at
the Edison School.
8-A: REGULATION OF ANTENNAS: Presented was the ordinance for
introduction and first reading amending Section 9.04.10 and
9.04.10.06 of the Santa Monica Municipal Code relating to the
regulation of nonparabolic and parabolic antennas; and adoption
of a resolution modifying planning, zoning and land use fees.
Council asked questions of staff. At 7:57 P.M., Mayor Abdo
declared the public hearing open. Member of the public Alan
Corlin requested that Council reduce the fee of $100. Members
of the public Mark Olson and Sharon O'Rourke requested that
public utilities be exempted from the proposed ordinance.
Member of the public Al Mergel discussed the needs of Southern
California Edison. Member of the public H. L. Marks spoke in
support of the proposed ordinance with amendments to heights.
Members of the public Larry Bryant, Carroll Lindholm, Randy
Powell, James Stockwell, Katherine Handelsman, Bruce Garvin,
and Joseph Flaherty spoke in support of the proposed ordinance.
Members of the public Burt Handelsman and William Handelsman
stated their belief that the proposed ordinance is unnecessary.
Member of the public Joy Fullmer expressed her concerns.
Members of the public Dave Dobrin and Joseph Pham spoke in
support of the proposed ordinance and urged a reduction in the
$100 fee. Member of the public John Barr spoke in support of
the proposed ordinance but questioned its need, urged a
reduction in the $100 fee, and suggested that Section
9.04.10.06.040 (Page 16) be amended to allow amateur radio
antennas to exceed the roofline by 15 feet rather than 10 feet.
Member of the public Richard Corlin urged Council to amend
Section 9.04.10.06.040 (Page 16) to allow amateur radio
antennas to exceed the roofline by 15 feet rather than 10 feet.
Member of the public Chris Harding expressed concern with the
TVRO section of the proposed ordinance. Mayor Abdo closed the
public hearing at 8:44 P.M. Discussion was held.
Councilmember Genser moved to adopt the staff recommendation
with the following changes: 1) the fee for the use permit be
reduced to $25; 2) Section 9.04.10.06.040 be changed to allow
amateur radio antennas to exceed the roofline by 15 feet; 3)
eliminate the exemption for the City's antennas. Second by
Mayor Abdo. Discussion was held. Councilmember Holbrook movedto amend the motion to eliminate the amateur radio operators
from the proposed ordinance. Second by Councilmember
Rosenstein. Discussion was held. The motion failed by the
following vote:

Councilmember Holbrook moved to amend the motion to change the
retractable section of the proposed ordinance that antennas
which are higher than 50' must be retractable to 35'. The
amendment was seconded by Councilmember Genser. The motion was
approved, Councilmember Olsen opposed. Councilmember Greenberg
moved to amend the motion to amend Section 9.04.10.06.160(a)(2)
to read: "The diameter of a TVRO parabolic antenna shall not
exceed twelve (12) feet and the diameter of a microwave relay
parabolic antenna shall not exceed four and one-half (4.5)
feet, unless required to be larger by state or federal law."
Second by Councilmember Holbrook. Discussion was held. The
motion failed by the following vote:

By virtue of the above action an ordinance entitled: "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AMENDING ARTICLE IX, CHAPTER 9.04, SUBCHAPTER 9.04.10, PART
9.04.10.06 OF THE SANTA MONICA MUNICIPAL CODE RELATING TO THE
REGULATION OF NONPARABOLIC AND PARABOLIC ANTENNAS," was
introduced, as amended, for first reading by title only,
waiving further reading thereof; and
Resolution No. 8814(CCS) entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF SANTA MONICA MODIFYING PLANNING, ZONING
AND LAND USE FEES," was adopted as amended.
At 9:31 P.M., Council adjourned for a recess. Council
reconvened at 9:55 P.M. with all members present.
Discussion was held. Mayor Abdo moved to include on the agenda
a brief period before Item No. 15 (Public Input) whereby the
City Manager will provide a brief update on construction at
Lincoln Park. Second by Councilmember Greenberg. Discussion
was held. The motion was unanimously approved.
8-B: TENANT RELOCATION ASSISTANCE: Presented was an ordinance
for introduction and first reading amending the Tenant
Relocation Assistance Ordinance to make its provisions
inapplicable when a tenancy is terminated pursuant to the Ellis
Act and the displaced tenant does not qualify as a lower income
household. Council asked questions of staff. At 10:05 P.M.,
Mayor Abdo declared the public hearing open. Members of the
public Joy Fullmer and Beloved Quail expressed their concerns.
Members of the public Evelyn Leeds, Alan Soney, Sandra Soney,
Doug Appel, Nick Murak spoke in opposition to the proposed
ordinance. Mayor Abdo closed the public hearing at 10:20 P.M.
Council asked questions of staff. Councilmember Genser movedto defer this item and ask staff to return with an ordinance
with something in the provisions as to procedures to determine
tenant eligibility. Second by Mayor Abdo. Discussion was
held. The motion was unanimously approved.
Staff Report
9-A: REVISION OF FEE SCHEDULE/WOODLAWN CEMETERY: The
resolution revising the fee schedule for Woodlawn Cemetery
services was withdrawn at the request of staff.
9-B: CLOSED SESSION: Held at the beginning of meeting. No
action taken.
10-A: ANNUAL STREET RESURFACING PROGRAM: Presented was the
public hearing to confirm the assessment of costs for FY 1992-
93 Annual Street Resurfacing Program and appurtenant work and
adopt a resolution. At 10:28 P.M., Mayor Abdo declared the
public hearing open. Member of the public Jack Rothaus
suggested that assessments be based on square footage of the
lot rather than lineal frontage. Mayor Abdo closed the public
hearing at 10:40 P.M. Council asked questions of staff.
Councilmember Greenberg moved to acknowledge all protests and
adopt Resolution No. 8803(CCS) entitled: "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF SANTA MONICA APPROVING THE
ASSESSMENT DIAGRAM AND CONFIRMING ASSESSED COSTS FOR GUTTER
CONSTRUCTION, STREET RESURFACING AND THE REPAIR OF DAMAGED
SIDEWALKS, DRIVEWAYS AND CURBS, AND THE REMOVAL OF DAMAGED
PARKWAY PAVINGS AND APPURTENANT WORK ON VARIOUS CITY STREETS IN
CUNJUNCTION WITH THE FY1992-93 STREET RESURFACING PROGRAM, "
reading by title only and waiving further reading thereof.
Second by Councilmember Holbrook. The motion was approved by
the following vote:

10-B: CENTURY SOUTHWEST CABLE TELEVISION: Presented was the
public hearing to consider adoption of a resolution pursuant to
FCC regulations issuing a "rate order" regarding Century
Southwest Cable Television, Inc. basic service rates and
associated charges for the period from September 1, 1993 to
July 14, 1994, and requesting further information regarding
delinquent account charges. At 10:45 P.M., Mayor Abdo declared
the public hearing open. Members of the public Jose Ortal,
William Handelsman, Sara Meric, and Allan Prival conveyed their
dissatisfaction with Century Cable. Member of the public Joy
Fullmer expressed her concerns. Mayor Abdo closed the public
hearing at 10:56 P.M. Councilmember Greenberg moved to extend
the meeting to 11:30 P.M. Second by Councilmember Rosenstein.
The motion was unanimously approved. Discussion was held.
Councilmember Greenberg moved to approve the order regarding
basic service rates and associated charges and request further
information regarding delinquent account charges, based on the
findings in the staff report and taking into consideration all
communications on this subject including written, PEN,
telephone, and in-person testimony. Second by Councilmember
Olsen. Discussion was held. The motion was approved by the

Councilmember Greenberg moved to adopt Resolution No. 8781(CCS)
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ADOPTING A RATE ORDER REGARDING BASIC SERVICE
RATES AND ASSOCIATED CHARGES OF CENTURY SOUTHWEST CABLE
TELEVISION, INC. AND REQUESTING FURTHER INFORMATION REGARDING
DELINQUENT ACCOUNT CHARGES," reading by title only and waiving
further reading thereof. Second by Councilmember Holbrook.
Discussion was held. The motion was approved by the following

14-A: STATUS OF REDEVELOPMENT/LINCOLN PARK: The request of
Councilmember Olsen to discuss the current status of the
redevelopment of Lincoln Park and the inaccurate information in
an article contained in Thursday's Santa Monica Outlook
regarding the relocation of the "Pioneer Day Picnic" was
withdrawn at the request of Councilmember Olsen.
City Manager Jalili presented a brief update on the status of
Lincoln Park. Council asked questions of staff. Discussion
was held. No action taken.
15: PUBLIC INPUT: Member of the public Ron Taylor discussed
the deaths of two homeless people and discussed the problems of
homelessness. Member of the public Art Casillas reported on
crime in Pico Neighborhood. Member of the public Beloved Quail
discussed the problems of homelessness.
ADJOURNMENT: At 11:35 P.M., the meeting was adjourned in
memory of Muriel Fowley, Judith Linfield, and Greg Paley.
