CITY COUNCIL MINUTES
OCTOBER 18, 1994
An adjourned meeting of the Santa Monica City Council was
called to order by Mayor Abdo at 6:48 P.M. on Tuesday, October
18, 1994, in the Council Chambers.

Councilmember Rosenstein led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.
Mayor Abdo moved to hear Item No. 14-C at the meeting of
October 25, 1994. Second by Councilmember Rosenstein.
Discussion was held. Councilmember Genser moved to amend the
motion to invite radio station KFI to attend the meeting. The
motion was accepted as friendly. The motion was unanimously
approved.
8-A: USE OF CITY-OWNED PARKING STRUCTURES: Presented was an
ordinance for second reading and adoption adding Section
3.36.280 to the Santa Monica Municipal Code regulating the use
of City-owned parking structures. Councilmember Holbrook moved
to adopt Ordinance No. 1772(CCS) entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION
3.36.280 TO THE SANTA MONICA MUNICIPAL CODE REGULATING THE USE
OF CITY OWNED PARKING STRUCTURES," reading by title only and
waiving further reading thereof. Second by Councilmember
Greenberg. Discussion was held. The motion was approved by
the following vote:
Council vote: Affirmative: Councilmembers Rosenstein, Olsen,
Holbrook, Greenberg, Genser
Negative: Councilmember V zquez, Mayor Abdo
Council asked questions of staff with regard to application of
the above ordinance. Discussion was held.
8-B: APPLICATION OF HEALTH AND SAFETY STANDARDS/SERVICE OF
MEALS TO THE PUBLIC WITHOUT CHARGE: Presented was an ordinance
for introduction and first reading relating to the application
of health and safety standards to the service of meals to the
public without charge. Council asked questions of staff. At
7:37 P.M., Mayor Abdo declared the public hearing open.
Members of the public Miriam Schocren, Gary Spivey, Ron Taylor,
Kevin Levy, Crystal Bell, Debbie Baxter, Celeste Marin, Kathy
Dahlgren, Katherine Hill, Edward Stabler, Maura LeBron, James
Dahlgren, Jennifer Rafeedie, Marcello Bice, Gerald Breen, Frank
Tamborello, Len Doucette, Taishin McLaughlin, Ruby Blevins,
Kenneth Barks, Reginald Rector, Conrad Decker, Jerry Rubin,
Catherine Bermudez, Robert Kirchner, MariElena Brown, Jane
Kostka, and James Daly spoke in opposition to the proposed
ordinance. Member of the public Joy Fullmer expressed her
concerns. Member of the public Bob Kronovet spoke in support
of the proposed ordinance. Councilmember Olsen moved to hear
late speakers. Second by Councilmember Rosenstein. The motion
was unanimously approved. Members of the public Amy Kofman and
Kari Thompson spoke in opposition to the proposed ordinance.
Member of the public John Rennell spoke in support of the
proposed ordinance. Mayor Abdo closed the public hearing at
8:58 P.M.
At 8:58 P.M., Council adjourned for a short recess. Council
reconvened at 9:22 P.M. with all members present.
8-B: APPLICATION OF HEALTH AND SAFETY STANDARDS/SERVICE OF
MEALS TO THE PUBLIC WITHOUT CHARGE (RESUMED): Council asked
questions of staff. Councilmember Greenberg moved to introduce
for first reading an ordinance entitled: "ORDINANCE OF THE
CITY OF SANTA MONICA RELATING TO THE APPLICATION OF HEALTH AND
SAFETY STANDARDS TO THE SERVICE OF MEALS TO THE PUBLIC WITHOUT
CHARGE," amended to add the following sections to the list of
exceptions in SECTION 1(a): "11.02.192, and 11.04.300 to
11.04.330...;" striking the following language on page 2: "and
all subsequent ordinances amending the incorporated sections of
Title 11 of the Los Angeles County Code...;" and adding the
word "are" after the word "individuals" on Page 1, in the first
WHEREAS clause, second line, reading by title only and waiving
further reading thereof. Second by Councilmember Olsen.
Discussion was held. Mayor Pro Tempore V zquez moved to amend
the motion to request staff to return with an information item
in six months addressing the impact this ordinance has had on
the indoor feeding programs administered by the City or feeding
programs allowed to be administered by outside sources
complying with this regulation. Discussion was held. The
motion was accepted as friendly. Discussion was held.
Councilmember Rosenstein moved to call the question and end
debate on this issue. Second by Mayor Pro Tempore V zquez.
The motion failed, Councilmembers Genser, Greenberg, Holbrook,
and Olsen opposed. Discussion was held. The motion was
approved by the following vote:

9-A: CLOSED SESSION: Held at end of meeting.
14-A: FEDERAL CRIME BILL: Presented was the request of
Councilmember Olsen to discuss directing staff to analyze the
recent Federal Crime Bill to determine the level of public
safety aid to Santa Monica. Members of the public Joy Fullmer
and Art Casillas expressed their concerns. Councilmember Olsen
moved to direct staff to analyze the recent Federal Crime Bill,
to return to Council with information as to available options,
and what monies can be secured from the Crime Bill to make the
City of Santa Monica a safer place. Second by Councilmember
Greenberg. Discussion was held. The motion was unanimously
approved.
14-B: LINCOLN PARK REDEVELOPMENT PLAN AND CONSTRUCTION:
Presented was the request of Councilmember Olsen to discuss
Lincoln Park redevelopment plan and construction. Member of
the public Susan Henderson encouraged Council to preserve trees
and open space. Council asked questions of staff. Discussion
was held. Councilmember Olsen moved to direct staff to
continue the renovation of Miles Playhouse, study the
historical significance of Miles Playhouse and make
recommendations as to how this could be addressed, continue
with the replacement of the trees in the park, and direct staff
to forward elevation designs for any other future park which
would go through this type of renovation to Council. Second by
Councilmember Genser. Council asked questions of staff. The
motion was unanimously approved.
14-C: PUBLIC APOLOGY/KFI RADIO STATION: The request of Mayor
Pro Tempore V zquez to discuss calling for a public apology
from KFI radio station concerning a public statement made on
their airwaves regarding homeless people was continued to the
meeting of October 25, 1994.
15: PUBLIC INPUT: Member of the public Joy Fullmer expressed
her concern with various issues.
City Attorney Moutrie announced that Council would not be
considering the case of Bell v. City of Santa Monica this
evening.
CLOSED SESSION: At 10:56 P.M., Council adjourned to Closed
Session for the purpose of conducting an evaluation of the City
Attorney and to discuss the City Clerk. No action was taken.
At 11:40 P.M., Council reconvened with all members present.
ADJOURNMENT: At 11:40 P.M., the meeting was adjourned to
Tuesday, October 25, 1994, at 6:30 P.M.
