SUBJECT: Recommendation to Approve Resolution Extending the Time
Period for Exercising the Landmarks Commission
Certificate of Appropriateness Permitting A Replacement
Fence at 415 Pacific Coast Highway
INTRODUCTION
This report recommends that the City Council extend by resolution
the time period for exercising Certificate of Appropriateness LC-
05-022C permitting the replacement of an existing wood fence with
a wood and metal fence at 415 Pacific Coast Highway, the site of
the North Guest House at the Marion Davies Estate. Pursuant to
Section 9.36.170(h) of the Santa Monica Municipal Code (SMMC)
this approved Certificate of Appropriateness will expire on April
10, 1995 if it is not extended by the City Council. Staff is
recommending a 180 day extension until October 10, 1995. The
City Council Resolution is contained in Attachment A.
BACKGROUND
The Landmarks Commission approved this Certificate of
Appropriateness permit on October 10, 1994. The project involves
replacing a deteriorating and damaged fence with a wood and metal
fence and gates at 415 Pacific Coast Highway.
As stipulated in the Landmarks Ordinance, permit approval expires
within 180 days unless the authorized work has begun. The City
Engineering Division has been unable to begin work on the project
within the time specified in the Certificate of Appropriateness
and has requested a six month extension.
On March 13, 1995, the Landmarks Commission recommended that the
City Council extend the Certificate approval for the maximum 180
day period. If the Certificate of Appropriateness is not
extended, the City Engineering Division would be required to
resubmit a Certificate of Appropriateness application and a new
public hearing would be required. As stated in Section 9.36.250
of the Landmarks Ordinance, Certificate of Appropriateness
approvals may only be extended by City Council resolution upon a
recommendation of the Landmarks Commission.
BUDGET/FINANCIAL IMPACT
The recommendation presented in this report does not have any
budget or fiscal impact.
RECOMMENDATION
It is respectfully recommended that the Council adopt the
attached resolution to extend Certificate of Appropriateness Lc-
02-006C for 180 additional days. The permit will then expire on
October 10, 1995.

WHEREAS, a Certificate of Appropriateness application was
filed requesting a replacement fence along Pacific Coast Highway
at 415 Pacific Coast Highway, historically known as the site of
the North Guest House at the Marion Davies Estate, on September
25, 1994; and
WHEREAS, the Landmarks Commission, following a public
hearing, approved the requested Certificate of Appropriateness on
October 10, 1994; and
WHEREAS, the Landmarks Commission recommended City Council
extend the Certificate of Appropriateness approval by resolution
for the maximum 180 day period on March 13, 1995; and
WHEREAS, pursuant to Santa Monica Municipal Code Section
9.36.170(h), this Certificate of Appropriateness shall expire if
the work authorized is not commenced within 180 days of the
approval; and
WHEREAS, this Certificate of Appropriateness shall expire
on April 10, 1995 unless otherwise extended; and
WHEREAS, the Landmarks Commission has recommended that the
City Council adopt a resolution extending this Certificate of
Appropriateness for the maximum permitted 180 days,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council has reviewed the Landmarks
Commission's recommendation and extends the Certificate of
Appropriateness permit for a replacement fence along Pacific
Coast Highway at 415 Pacific Coast Highway for an additional 180
days.
SECTION 2. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
