                     CITY COUNCIL MINUTES

                        AUGUST 20, 1996


A special meeting of the Santa Monica City Council was called
to order by Mayor Rosenstein at 6:42 p.m., on Tuesday, August
20, 1996, in the Council Chambers.

                    Councilmember Ken Genser
                    Councilmember Robert T. Holbrook
                    Councilmember Pamela O'Connor

          Absent:   Councilmember Judy Abdo
                    Councilmember Ruth Ebner

          Also Present:  City Manager John Jalili
                    Assistant City Attorney Joseph Lawrence
                    Assistant City Clerk Beth Sanchez

Councilmember Holbrook led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.  

8-A: USE OF PUBLIC SIDEWALKS: Presented was an emergency
ordinance for adoption  or an ordinance for introduction and
first reading deleting Santa Monica Municipal Code Sections
3.12.350, relating to the use of public sidewalks, and
replacing it with a prohibition against sitting or lying on
sidewalks in the Bayside District and on the Third Street
Promenade Roadway during specified hours.
       Staff Report

Motion by Councilmember Genser to re-open public hearing for
those people who did not previously speak to this item.  Motion
died for lack of a second.

Motion by Councilmember Holbrook, seconded by Mayor Pro Tempore
Greenberg, to adopt Ordinance No.1860(CCS) entitled "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DELETING SANTA MONICA MUNICIPAL CODE SECTION 3.12.350, RELATING
TO THE USE OF PUBLIC SIDEWALKS, AND REPLACING IT WITH A
PROHIBITION AGAINST SITTING OR LYING ON SIDEWALKS IN THE
BAYSIDE DISTRICT AND ON THE THIRD STREET PROMENADE ROADWAY AND
DECLARING 


THE PRESENCE OF AN EMERGENCY", reading by title only and waiving
further reading thereof.  Discussion was held.  Councilmember
O'Connor indicated that she would be willing to vote for the
emergency ordinance if it included a sunset clause.  Mayor Pro
Tempore Greenberg suggested revisiting the ordinance in six
months.  Mayor Rosenstein suggested an amendment to the main
motion that, before the end of February 1997, staff agendize
this item for public discussion, analysis of how the ordinance
is working and any recommendations for appropriate changes to
the ordinance.  The maker of the motion agreed to this
amendment to the main motion.

The motion, as amended, was approved by the following vote:

     Ayes:          Councilmembers O'Connor, Holbrook, Genser, 
               Mayor Pro Tem Greenberg, Mayor Rosenstein
     Noes:          None
     Absent:   Councilmembers Abdo and Ebner

15.  PUBLIC INPUT: Member of the public Joi Fullmer expressed
her concerns. Member of the public Art Casillas expressed his
concerns regarding investigation of safety issues.  Members of
the public Ron Taylor and Douglas Woodworth spoke in opposition
to the emergency ordinance adopted tonight, and Dan Ehrler
thanked Council for adjourning in memory of his father on
August 13, 1996.

ADJOURNMENT: At 7:03 p.m., the meeting was adjourned to the
regular meeting on Tuesday, September 10, 1996 at 6:30 p.m.
