OCTOBER 8, 1996
A regular meeting of the Santa Monica City Council was called
to order by Mayor Rosenstein at 6:39 p.m., on Tuesday, October
8, 1996, in the Council Chambers.

Councilmember Holbrook led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.
6. CONSENT CALENDAR: The Consent Calendar was presented,
whereby all items are considered and approved in one motion
unless removed from the calendar for discussion.
Member of the public Joi Fullmer discussed items on the Consent
Calendar.
Motion by Mayor Pro Tem Greenberg, seconded by Councilmember
Ebner, to approve the Consent Calendar, reading resolutions by
title only and waiving further reading thereof. The motion was
approved by the following vote:

6-B: CONTINUING EXISTENCE OF A LOCAL EMERGENCY (JANUARY 1994
EARTHQUAKE DAMAGE): Resolution No. 9091(CCS) entitled: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DECLARING THE EXISTENCE OF A CONTINUING LOCAL EMERGENCY," was
adopted.

6-C: DEMOLITION/EARTHQUAKE DAMAGED RED AND YELLOW TAGGED
BUILDINGS: Ordinance No. 1865(CCS) entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA
MONICA MUNICIPAL CODE SECTION 9.04.10.16.010 CONCERNING
DEMOLITION PERMIT REQUIREMENTS," was adopted.

Resolution No. 9092(CCS) entitled: "A RESOLUTION OF THE CITY

OF CERTAIN RECORDS OF THE POLICE DEPARTMENT PURSUANT TO

6-E: WAIVE RENTAL AND PARKING FEES/EAST WING OF CIVIC CENTER/
LEAGUE OF WOMEN VOTERS OF SANTA MONICA PROPOSITION 209
CALIFORNIA CIVIL RIGHTS INITIATIVE FORUM: The request to waive
rental and parking fees for the use of the East Wing of the
Civic Center on October 28, 1996, for the League of Women
Voters of Santa Monica Proposition 209 California Civil Rights
Initiative Forum was approved.

6-F: PROFESSIONAL SERVICES CONTRACT/MASTER PLAN/CORPORATION
YARD: Contract Number 6542(CCS) was approved with
RNL/Interplan, in an amount not to exceed $330,000, for
consulting services to prepare a master plan for the
corporation yard in the City of Santa Monica.

6-G: AWARD OF CONTRACT/CONSTRUCTION IMPROVEMENTS/SANTA MONICA
SMART CORRIDOR EXTENSION PROJECT: Contract Number 6543(CCS) was
awarded to C.T.&F., Inc., in an amount not to exceed
$1,300,874, for construction improvements relative to the Santa
Monica Smart Corridor Extension Project.

6-H: AWARD OF CONTRACT/TELEVISION VIDEO INSPECTIONS/CLEANING/
SEWER MAINS: Contract Number 6544(CCS) was awarded to National
Plant Services, Inc., in an amount not to exceed $164,275, for
television video inspections and cleaning of sewer mains 6" to
12" in diameter, at various City locations.

6-I: REJECT BIDS/TANDEM DRIVE TRUCK TRACTOR: The recommendation
to reject bids to furnish and deliver one new 80,000 pound
gross carrying weight (GCW) tandem drive truck tractor was
approved and staff was directed to continue to research the
open market for possible competitive bids.
6-J: PROFESSIONAL SERVICES CONTRACT/ANALYSIS OF OCEAN FRONT
VEHICLE CIRCULATION: Contract Number 6545(CCS) with Meyer,
Mohaddes Associates, was approved in an amount not to exceed
$53,700, for consulting services to prepare an analysis of
ocean front vehicle circulation, to evaluate circulation and
parking issues resulting from peak usage and special events.

6-K: AWARD OF BID/ALLISON TRANSMISSIONS: Bid No. 2594 was
awarded to S & J Chevrolet, at specified unit prices, to
provide remanufactured Allison Transmissions for the
Transportation Department.

6-L: AWARD OF BID/REBUILD DIFFERENTIAL ASSEMBLIES/REPLACE
PARTS: Bid No. 2595 was awarded to Big Trucks Inc., at
specified unit prices, to rebuild differential assemblies and
replace parts for GMC and MCI Buses, for the Transportation
Department.

No. 2550 was awarded to Maurice Sopp & Son, in an amount not to
exceed $30,870.73, to furnish and deliver one new 1995 CNG-powered one-ton cab and chassis for the Fleet Division,
Environmental and Public Works Department.

Ackerman Emergency Equipment Company, in the amount of
$86,425.33, to furnish and deliver one new and unused 1996 Type
III, slant side modular ambulance mounted on a new and unused
1996 Ford cut-away 10,000 GVW Chassis.

7-A: APPEAL/CUP 95-017/DRIVE-UP WINDOW/JACK-IN-THE-BOX/2025
LINCOLN BOULEVARD: Appeal 96-004 of Planning Commission
Approval of Conditional Use Permit Application 95-017 to allow
the late-night operation of the drive-up window in the Jack-in-the-Box restaurant located at 2025 Lincoln Boulevard until May
1, 1998, was continued to the meeting of October 22, 1996.
7-B: APPEAL/CUP 95-016/VAR 95-033/DRIVE-UP WINDOW/JACK-IN-THE-BOX RESTAURANT/2423 WILSHIRE BOULEVARD: Appeal 95-016 of
Planning Commission Approval of Conditional Use Permit
Application 95-016 and Variance Application 95-033 to allow
the late-night operation of the drive-up window in the Jack-in-the-Box restaurant located at 2423 Wilshire Boulevard until May
1, 1998, was continued to the meeting of October 22, 1996.
8-A: INTERIM ORDINANCE/PROHIBITION OF SECOND DWELLING UNITS/R-1
AND OP-1 ZONING DISTRICTS: Presented was an interim ordinance
prohibiting second dwelling units in the R-1 and OP-1 Zoning
Districts subject to limited exceptions, clarifying the
allowance of second units in Multi-Family Residential Districts
and specifying standards for second units.
On order of the Mayor, the public hearing was opened.

Member of the public Joi Fullmer expressed her concerns.
Member of the public Hank Koning suggested the implementation
of an amnesty program and utilizing existing units as case
studies to determine impact of such units.
The following members of the public spoke in support of the
proposed ordinance: Arthur Eskelin, Polly Benson-Brown, Terry
Graboski, Norman Peterson, Jim Zukor, Veronica Salvesen, Frank
Schwengel, Leigh Hovey, and Nina Terebinski.
The following members of the public suggested an amendment to
the proposed ordinance to expand exceptions to include
relatives and household help: Annette Dordoni and Shari Davis.
The following members of the public spoke in opposition to the
proposed ordinance: Chris Harding, George Balanis, and John
Phillips.
Motion by Councilmember Abdo, seconded by Councilmember
O'Connor, to hear late speakers. The motion was unanimously
approved by voice vote.
The following members of the public spoke in support of the
proposed ordinance: Emmalie Hodgin and Briony Bax.
The following member of the public spoke in opposition to the
proposed ordinance: Margery Somers.
Member of the public Lou Moench discussed parking issues
related to the proposed ordinance.
There being no other speakers, the Mayor closed the public
hearing.
Discussion ensued as to the comments heard from the public
relative to increased traffic problems, impact on the school
system, impact on the homeowners that would benefit from the
addition and the impact on homeowners that are in opposition to
the ordinance. There was further discussion as to the effects
of taking action, and effects of not taking action, within the
120 days dictated by State law.
At the suggestion of the City Attorney, because of the
potential lawsuit arising from a decision regarding this
matter, Council adjourned at 8:00 p.m. to the following closed
session:
Closed Session for conference with Legal Counsel regarding
one case of anticipated litigation.
At 8:55 p.m., Council reconvened with all members present.
Motion by Mayor Pro Tem Greenberg, seconded by Councilmember
Ebner, to approve the proposed ordinance with the following
modifications: 1) amend SECTION 6 to delete the language "parent
or child" and substitute in its place "dependent or caregiver;"
2) add a provision that the property be deed restricted so that
the second unit cannot be rented; and, 3) direct staff to
develop some mechanism to ensure compliance.
The motion was approved by the following vote:

By virtue of the above action, an ordinance entitled: "INTERIM
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
PROHIBITING SECOND DWELLING UNITS IN THE R-1 AND OP-1 ZONING
DISTRICTS SUBJECT TO LIMITED EXCEPTIONS, CLARIFYING THE
ALLOWANCE OF SECOND UNITS IN MULTI-FAMILY RESIDENTIAL DISTRICTS
AND SPECIFYING STANDARDS FOR SECOND UNITS," as amended, was
introduced for first reading by title only, waiving further
reading thereof.
8-B: PROHIBITION OF SALE/SATURDAY NIGHT SPECIALS: Presented was
an ordinance adding Chapter 3.26 to the Municipal Code
prohibiting the sale of certain handguns commonly known as
"Saturday Night Specials."

Motion by Councilmember Abdo, seconded by Mayor Rosenstein, to
introduce for first reading an ordinance entitled: "AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING CHAPTER
3.26 TO THE MUNICIPAL CODE PROHIBITING THE SALE OF CERTAIN
HANDGUNS COMMONLY KNOWN AS SATURDAY NIGHT SPECIALS," reading by
title only and waiving further reading thereof. The motion was
approved by the following vote:

10-A: MAIN STREET ASSESSMENT DISTRICT/MAIN STREET IMPROVEMENT
AREA: The public hearing to hear and acknowledge protests from
property owners regarding the Main Street Assessment District
and from business owners regarding the Main Street Business
Improvement Area was withdrawn at the request of staff.
13-A: R. SCOTT BRUTZMAN/PROMENADE GARAGE PARKING: R. Scott
Brutzman was not present to address Council regarding Promenade
garage parking.

15: PUBLIC INPUT: Member of the public Joi Fullmer expressed
her concerns on various issues.
