OCTOBER 15, 1996
A special meeting of the Santa Monica City Council was called
to order by Mayor Pro Tempore Greenberg at 7:40 p.m., on
Tuesday, October 15, 1996, in the Council Chambers.

Councilmember Holbrook led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.
8-A: INTERIM ORDINANCE/PROHIBITION OF SECOND DWELLINGS IN R-1
AND OP-1 ZONING DISTRICTS: Presented was an Interim
Ordinance of the City Council of the City of Santa
Monica for second reading and adoption prohibiting
second dwelling units in the R-1 and OP-1 Zoning
Districts subject to limited exceptions, clarifying the
allowance of second units in Multi-Family Residential
Districts and specifying standards for second units.
(Introduced October 8, 1996)
Staff Report
Motion by Councilmember Ebner, seconded by Councilmember
Holbrook, to hold second reading of, and adopt Ordinance
No. 1866(CCS) entitled "AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA PROHIBITING SECOND DWELLING
UNITS IN THE 4-1 AND OP-1 ZONING DISTRICTS SUBJECT TO
LIMITED EXCEPTIONS, CLARIFYING THE ALLOWANCE OF SECOND
UNITS IN MULTI-FAMILY RESIDENTIAL DISTRICTS AND
SPECIFYING STANDARDS FOR SECOND UNITS," reading by title
only and waiving further reading thereof. The motion
was approved by the following vote:
Ayes: Councilmembers Ebner, Holbrook, Genser,
Mayor Pro Tem Greenberg
Noes: Councilmember Abdo
Absent: Councilmember O'Connor, Mayor Rosenstein
Councilmember Abdo stated she voted against the ordinance for
the same reasons she has stated before, mainly that it will
cause problems among neighbors, and expressed the belief that
adoption of the ordinance will cause a hardship for those
individuals who currently have such units. She added that she
did not believe the impact from second units on the R1 Zone
would be that great.
8-B: ORDINANCE FOR SECOND READING/ "SATURDAY NIGHT SPECIALS"
Presented was an Ordinance of the City Council of the
City of Santa Monica for second reading and adoption
adding Chapter 3.26 to the Municipal Code prohibiting
the sale of certain handguns commonly known as "Saturday
Night Specials." (Introduced October 8, 1996.)
Staff Report
Motion by Councilmember Abdo, seconded by Councilmember
Genser, to hold second reading of, and adopt Ordinance
No. 1867(CCS) entitled "AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ADDING CHAPTER 3.26 TO THE
MUNICIPAL CODE PROHIBITING THE SALE OF CERTAIN HANDGUNS
COMMONLY KNOWN AS SATURDAY NIGHT SPECIALS,'" reading by
title only and waiving further reading thereof. The
motion was approved by the following vote:
Ayes: Councilmembers Abdo, Ebner, Holbrook,
Genser,
Mayor Pro Tem Greenberg
Noes: None
Absent: Councilmember O'Connor, Mayor Rosenstein
15. PUBLIC INPUT: The following members of the public
addressed the City Council:
Joan Antonovich expressed concerns regarding the status of a
contract her firm had with the City; Joi Fullmer expressed
concerns regarding various matters; Joan Huff spoke regarding
subsidized housing; Art Casillas expressed concerns regarding
various matters; and Sheila Wells expressed appreciation to the
City Council for the Funding awarded to the Symphony Orchestra.
9-A: CLOSED SESSIONS: At 8:03 p.m., on order of the Mayor,
the City Council recessed, and then reconvened at 8:38
p.m., to announce actions taken on the following
matters:
1. Conference with Legal Counsel - Existing Litigation:
Len Doucette v. City of Santa Monica, Case No.
CV 95-1136 WDK (Mcx).
There as no formal action taken on this matter.
2. Conference with Legal Counsel - Existing Litigation:
Marchand v. City of Santa Monica, Case No. SC 036789
Motion by Councilmember Holbrook, seconded by
Councilmember Abdo, to approve settlement in the amount
of $55,000. The motion was approved by the following
vote:
Ayes: Councilmembers Abdo, Ebner, Holbrook,
Genser,
Mayor Pro Tem Greenberg
Noes: None
Absent: Councilmember O'Connor, Mayor Rosenstein
ADJOURNMENT: At 8:39 p.m., on order of the Mayor, the meeting
was adjourned to the regular meeting on Tuesday, October 22,
1996 at 6:30 p.m.
