                       NOVEMBER 19, 1996


A regular adjourned meeting of the Santa Monica City Council
was called to order by Mayor Rosenstein at 7:05 p.m., on
Tuesday, November 19, 1996, in the Council Chambers.

Councilmember Holbrook led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.

8-A: SECOND DWELLING UNITS:  
       Staff Report

Councilmember Holbrook explained that due to a family emergency
he had to leave the meeting immediately to go to the hospital. 
Mayor Rosenstein advised, for the record, that although he
would normally be voting against adopting staff recommendation,
in light of Councilmember Holbrook's emergency and so as to
allow him to leave the meeting early, he (Mayor Rosenstein)
would cast a courtesy "yes" vote on this matter for
Councilmember Holbrook.

Councilmember Holbrook was excused from the meeting at 7:10
p.m.

Presented was an ordinance for introduction and first reading
of an Interim Ordinance of the City Council of the City of
Santa Monica Allowing Second Dwelling Units in the R-1 and OP-1
Zoning Districts Under Specified Circumstances, Clarifying the
Allowance of Second Units in Multi-Family Residential
Districts, Specifying Standards for Second Units.

On order of the Mayor, the public hearing was opened.

Member of the public Joi Fullmer expressed her concerns.

Members of the public Chris Harding and Lou Moench spoke in
opposition to the proposed ordinance.

Motion by Mayor Rosenstein, seconded by Councilmember Abdo, to
hear a late speaker.  The motion was approved by voice vote,
with Councilmember Genser opposing and Councilmember Holbrook
absent.

Member of the public Tom Larmore spoke in support of
restricting second units in the R-1 zone as much as legally
possible; however, expressed concerns with the proposed
ordinance.  There being no other speakers, the Mayor closed the
public hearing.

Motion by Councilmember Genser to introduce the ordinance for
first reading amending same to eliminate Section 6(l) on page
16 (Prohibition Against Rental).  The motion died for lack of a
second.

Motion by Mayor Pro Tem Greenberg, seconded by Councilmember
Genser, to introduce the ordinance adding language to stipulate
that second units shall not be rented except to those persons
whose occupancy is authorized by Section 6 of this ordinance.

The motion was approved by the following vote:

     Ayes:     Councilmembers Genser, Ebner, Mayor Pro Tem
               Greenberg, 
               Mayor Rosenstein
     Noes:     Councilmembers O'Connor, Abdo
     Absent:   Councilmember Holbrook

Councilmember Abdo requested the record reflect that she voted
"no" because of the same concerns she has expressed in previous
meetings regarding this matter.

Councilmember O'Connor requested the record reflect that she
voted "no" because of the same concerns she has expressed in
previous meetings regarding this matter.

Mayor Rosenstein clarified his "yes" vote was a courtesy vote
on behalf of Councilmember Holbrook, who left early due to a
family emergency.

By virtue of the above action, an ordinance entitled: "INTERIM
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
ALLOWING SECOND DWELLING UNITS IN THE R-1 AND OP-1 ZONING
DISTRICTS UNDER SPECIFIED CIRCUMSTANCES, CLARIFYING THE
ALLOWANCE OF SECOND UNITS IN MULTI-FAMILY RESIDENTIAL
DISTRICTS, AND SPECIFYING STANDARDS FOR SECOND UNITS," was
introduced for first reading by title only, waiving further
reading thereof.


9-A: SCHEDULE OF COUNCIL MEETINGS: Motion by Mayor Rosenstein,
seconded by Mayor Pro Tem Greenberg, to conduct meetings on
November 26, December 10, and December 17, 1996.  The motion
was unanimously approved by voice vote, with Councilmember
Holbrook absent.
       Staff Report

12-A: MEMORANDUM OF UNDERSTANDING/MUNICIPAL EMPLOYEES
ASSOCIATION: Presented was the staff report recommending
adoption of a resolution authorizing the City Manager to
execute a Memorandum of Understanding with the Municipal
Employees Association (MEA).
       Staff Report

Motion by Councilmember Ebner, seconded by Councilmember
O'Connor, to adopt Resolution No. 9101(CCS) entitled: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AMENDING THE MEMORANDUM OF UNDERSTANDING WITH THE MUNICIPAL
EMPLOYEES ASSOCIATION."  The motion was approved by the
following vote:

     Ayes:     Councilmembers Genser, Ebner, O'Connor, Abdo, 
               Mayor Pro Tem Greenberg, Mayor Rosenstein
     Noes:     None
     Absent:   Councilmember Holbrook

15: PUBLIC INPUT: Member of the public Joi Fullmer expressed
her concerns on various subjects.

9-B: CLOSED SESSION:  At 8:04 p.m., Council adjourned to Closed
Session, and reconvened at 10:10 p.m., to report the following:

1.   Conference with Legal Counsel - Anticipated Litigation
     Cases: two

     The following action was taken regarding one of the above
     cases:

     Motion by Councilmember Ebner, seconded by Councilmember
     Genser, to authorize settlement with Herb Graham in the
     amount of $89,429.48.  The motion was approved by the
     following vote:

     Ayes:     Councilmembers Abdo, O'Connor, Ebner, Genser,
               Mayor Rosenstein
     Abstain:  Mayor Pro Tem Greenberg
     Noes:     None
     Absent:   Councilmember Holbrook
     There was no action taken on the second anticipated
     litigation case.

2.   Conference with Legal Counsel - Pending Litigation
     Pacific Beach Development v. City of Santa Monica, Case
     No. SC 013910

     There was no action taken on this matter.

3.   Public Employee Evaluations
     Employee Titles: City Attorney

     The employee evaluations were continued to the meeting of
     November 26, 1996.

ADJOURNMENT:  At 10:15 p.m., the meeting was adjourned to
Tuesday, November 26, 1996.
