                          MAY 13, 1997


A regular meeting of the Santa Monica City Council was called
to order by Mayor O'Connor at 6:44 p.m., on Tuesday, May 13,
1997, in the Council Chambers.

Councilmember Feinstein led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.

INSPIRATION: A moment of inspiration was provided by the John
Adams Middle School Madrigal Singers.

4-A: PROCLAMATION/SALVATION ARMY WEEK/MAY 12-18, 1997: Mayor
O'Connor presented a proclamation declaring the week of May 12-
18, 1997, as "Salvation Army Week" in the City of Santa Monica.

4-B: PROCLAMATION/TRY TRANSIT WEEK/MAY 12-16, 1997: Mayor
O'Connor presented a proclamation declaring the week of May 12-
16, 1997, as "Try Transit Week" in the City of Santa Monica.

4-C: PROCLAMATION/OLDER AMERICANS MONTH/MAY 1997: Mayor
O'Connor presented a proclamation declaring the month of May
1997 as "Older Americans Month" in the City of Santa Monica.

4-D: PROCLAMATION/NATIONAL HISTORIC PRESERVATION WEEK/MAY 12,
1997: Mayor O'Connor presented a proclamation declaring the
week of May 12, 1997, as "National Historic Preservation Week"
in the City of Santa Monica.

6.   CONSENT CALENDAR:  The Consent Calendar was presented,
whereby all items are considered and approved in one motion
unless removed from the calendar for discussion.

Mayor O'Connor announced that Item No. 6-B was withdrawn at the
request of staff.

Members of the public Joi Fullmer addressed items on the
Consent Calendar.

At the request of Councilmember Feinstein Item No. 6-H was
removed from the Consent Calendar.

Councilmember Ebner excused at 7:06 p.m.

Motion by Councilmember Genser, seconded by Councilmember
Greenberg, to approve the Consent Calendar, with the exception
of Item Nos. 6-B and 6-H, reading resolutions and ordinances by
title only and waiving further reading thereof.  The motion was
approved by the following vote:

               Rosenstein,

6-A:  CONTINUING EXISTENCE OF A LOCAL EMERGENCY (JANUARY 1994
EARTHQUAKE DAMAGE):  Resolution No. 9140(CCS) entitled:  "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DECLARING THE EXISTENCE OF A CONTINUING LOCAL EMERGENCY," was
adopted.

6-C: AWARD OF BID/AERIAL FIRE APPARATUS: Bid No. 2616 was
awarded to KME Fire Apparatus, in an amount not to exceed
$648,395.85, to furnish and deliver one new tractor drawn
aerial fire apparatus for the Fire Suppression and Rescue
Division, Fire Department; and all other bids were rejected for
the loose equipment.

6-D: AWARD OF BID/ROLLER/DRUM/TRAILER: Bid No. 2629 was awarded
to Ingersol Rand Company, in an amount not to exceed
$36,906.76, to furnish and deliver one new roller with 47" drum
and trailer for the Street Maintenance Division, Environmental
and Public Works Department.

6-E: REMEDIATION ACTIVITIES/AIRPORT ADMINISTRATION BUILDING:
The amendment to Agreement No. 6043 with Converse Environmental
West was approved, in an amount not to exceed $54,235, for
continued remediation activities at the Airport Administration
Building.

6-F: SALARY RATES/ADMINISTRATIVE ANALYST - MERL/BUSINESS
ASSISTANT - LIBRARY/DATABASE ADMINISTRATOR/ GIS ANALYST/POLICE
RECORDS TECHNICIAN/VIDEO INTERN: Resolution No. 9141(CCS)
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA ESTABLISHING NEW CLASSIFICATIONS AND ADOPTING SALARY
RATES FOR ADMINISTRATIVE ANALYST - MERL, BUSINESS ASSISTANT -
LIBRARY, DATABASE ADMINISTRATOR, GIS ANALYST, POLICE RECORDS
TECHNICIAN AND VIDEO INTERN," was adopted.

6-G: U.S. CONSTITUTION DAY PARADE: Resolution No. 9142(CCS)
entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA AUTHORIZING THE HOLDING OF A PARADE ON SEPTEMBER 20,
1997, ON A ROUTE OTHER THAN THE OFFICIAL CITY PARADE ROUTE," was
adopted.

6-B: AWARD OF BID/DUMP TRUCK: The award of Bid No. 2623 to
Boerner Truck Center, in an amount not to exceed $140,613.07,
to furnish and deliver one new all wheel drive 6x6 dump truck
for the Beach Maintenance Division, Environmental and Public
Works Management Department, was withdrawn at the request of
staff.

6-H: CONFIRMATION OF APPOINTMENTS/TELECOMMUNICATIONS WORKING
GROUP: Councilmember Feinstein advised that he removed this
item from the Consent Calendar due to its significance and
briefly reviewed the background contained in the staff report.

Motion by Councilmember Feinstein, seconded by Councilmember
Rosenstein, to confirm appointments to the Telecommunications
Working Group which will participate in the preparation of a
Telecommunications Master Plan.  The motion was approved by the
following vote:

8-A: ORDINANCE/PARKING FACILITIES/"A" OFF-STREET PARKING OVERLAY
DISTRICT: Presented was an ordinance for second reading and
adoption amending Section 9.04.08.38.050 and Section
9.04.08.38.090 of the Santa Monica Municipal Code regarding
conditionally permitted uses and design standards applicable to
parking facilities in the "A" Off-Street Parking Overlay
District.

Motion by Councilmember Genser, seconded by Councilmember
Feinstein, to adopt on second reading Ordinance No. 1878(CCS)
entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS
9.04.08.38.050 AND 9.04.08.38.090 REGARDING CONDITIONALLY
PERMITTED USES AND DESIGN STANDARDS APPLICABLE TO PARKING
FACILITIES IN THE "A" OFF-STREET PARKING OVERLAY DISTRICT,"
reading by title only and waiving further reading thereof. The
motion was approved by the following vote:

     Ayes:     Councilmembers Rosenstein, Genser, Feinstein,
               Mayor O'Connor
     Abstain:  Councilmembers Ebner, Greenberg, Mayor Pro Tem
               Holbrook
     Noes:     None

14-A: GLOBAL WARMING: Presented was the request of
Councilmember Feinstein to discuss the potential local effects
of global warming and to give direction to staff relative to
this matter.

Member of the public Joi Fullmer expressed her concerns.

Motion by Councilmember Feinstein, seconded by Councilmember
Genser, to direct the Environment and Public Works Management
Department and the Environmental Task Force to explore the
issue of the potential effects of global warming under
consideration and return to Council with information as to how
such information will be gathered, and begin networking with
appropriate agencies and organizations around the United States
and throughout the world to gather such information.  The
motion was unanimously approved by voice vote.

14-B: SANTA MONICA-MALIBU UNIFIED SCHOOL DISTRICT/UTILIZATION
OF FUNDS: Presented was the request of Councilmember Rosenstein
and Mayor Pro Tem Holbrook to discuss directing staff to confer
with the Santa Monica-Malibu Unified School District
administration to develop a plan to ensure that City funds
directed to the school district will be utilized in schools
located within the boundaries of the City of Santa Monica.

Councilmember Rosenstein introduced this matter by advising
that although he found it difficult to raise this manner in
this fashion, the impending budget deliberations made it
necessary for the issue to be brought to the attention of the
public, to be discussed, and for decisions to be made.


Mayor O'Connor opened the meeting to public participation.

Members of the public Julia Brownley, Linda Gross, and Joanne
Leavitt spoke in opposition to the restriction of City funding
to schools located within the boundaries of the City of Santa
Monica.

Members of the public Irene Zivi, Kathy Ishler, and Dorothy
Chapman spoke in support of the restriction of City funds to
schools located within the boundaries of the City of Santa
Monica.

Councilmember Rosenstein raised a point of order regarding the
relevancy of questions regarding the process of placing agenda
items on the School District's agenda that were being asked of
Dorothy Chapman by Councilmember Genser.  Mayor O'Connor ruled
the line of questioning relevant.

Motion by Councilmember Rosenstein to appeal the decision of
the chair.  The motion was approved by voice vote with
Councilmembers Feinstein and Genser, and Mayor O'Connor
opposed.

Member of the public Elizabeth Hoag discussed the importance of
accurate data and urged staff to work with the Board of
Education to determine where money is needed.

Members of the public Patricia Hoffman, Ralph Mechur, Margaret
Franco, Todd Hess, and Pam Brady spoke in opposition to
restricting City funds to schools located within the boundaries
of the City of Santa Monica.

Motion by Councilmember Genser, seconded by Councilmember
Feinstein, to hear a late speaker.  The motion was unanimously
approved by voice vote.

Member of the public Susan Belonis discussed the contributions
made by the residents of Malibu to the school district.

Dr. Neil Schmidt, Superintendent of Schools, Santa Monica-
Malibu Unified School District, made clarifications and
presented himself for questions from Council members.

On order of the Mayor, the City Council recessed at 9:32 p.m.,
and reconvened at 10:10 p.m., with all members present.

There was considerable discussion among Councilmembers
regarding the merits of requesting the school district to
restrict the expenditure of City funds to schools located
within the boundaries of the City of Santa Monica versus the
negative administrative effect on programs and services
provided by the school district if the funds are segregated.

Motion by Councilmember Rosenstein, seconded by Councilmember
Greenberg, to direct staff to confer with the Santa Monica-
Malibu Unified School District administration to develop a plan
to ensure that City funds directed to the school district will
be utilized in schools located within the boundaries of the
City of Santa Monica; that a progress report be presented to
Council prior to its meeting of June 24, 1997; authorize staff
to include some council members in the discussion with the
school district and school board members, if appropriate;
authorize the City Manager to engage in discussions with the
City of Malibu about mutual interests in regard to school
funding, and involve council members, if appropriate.  

Motion by Councilmember Genser, not accepted as friendly, to
amend the motion that rather than stipulating a restriction of
funding to schools within the boundaries of the City of Santa
Monica, to state the goal as doing that which is best in
directing resources toward helping the children in Santa Monica
schools.

Motion by Councilmember Genser, not accepted as friendly, to
amend the motion to ask staff and/or the liaison committee to
develop a work plan and update for Council review prior to
budget.

Substitute motion by Councilmember Genser, seconded by
Councilmember Feinstein, to direct staff to confer with the
Santa Monica-Malibu Unified School District administration to
develop a process to determine how to best serve the students
in Santa Monica Schools; that a progress report be presented to
Council prior to its meeting of June 24, 1997; authorize staff
to include some council members in the discussion with the
school district and school board members, if appropriate;
authorize the City Manager to engage in discussions with the
City of Malibu about mutual interests in regard to school
funding.  The motion failed by the following vote:

     Ayes:     Councilmembers Feinstein, Genser, Mayor O'Connor
     Abstain:  Councilmembers Greenberg, Rosenstein, Ebner,
               Mayor Pro Tem Holbrook
     Noes:     None

The main motion, made by Councilmember Rosenstein and seconded
by Councilmember Greenberg, was approved by the following vote:

     Ayes:     Councilmembers Greenberg, Rosenstein, Ebner,
               Mayor Pro Tem Holbrook
     Abstain:  Councilmembers Feinstein, Genser, Mayor O'Connor
     Noes:     None

Mayor O'Connor requested that the record reflect that she voted
"no" on this motion because she feels that there may be
financial, programmatic, administrative, and service-related
adverse impacts on students in Santa Monica from this limited
direction.

14-C: APPOINTMENT/CONVENTION AND VISITORS BUREAU: The
appointment to an unscheduled vacancy on the Convention and
Visitors Bureau (1) for a term ending June 30, 1998, was
continued to the meeting of May 27, 1997.

15: PUBLIC INPUT: Member of the public Joi Fullmer expressed
her concerns on various issues.

Member of the public Jacqueline Lambrikets voiced her concerns
about the City of Santa Monica Well Fill Solution and the role
the Underground Storage Tank Program at the Los Angeles County
Water Quality Control Board had in its inability to foresee and
respond to such a calamity.

Member of the public Jim Tomlin discussed the negative impact
of changing the parking meters from 6 p.m. to 2 a.m.

Motion by Councilmember Feinstein, seconded by Councilmember
Genser, to extend the meeting past 11 p.m.  The motion was
unanimously approved by voice vote.

Member of the public Brian Hutchings discussed the situation in
Zaire and global warming.

16: CLOSED SESSION: At 11:07 p.m., Council adjourned to Closed
Session.

16-A: CLOSED SESSION/CONFERENCE WITH LEGAL COUNSEL:

     Existing Litigation: City of Santa Monica v. Mobil Oil
     Corporation et al., Case No. SC045788.
     ACTION: Heard.  No action taken.

ADJOURNMENT:  At 12:25 a.m., the meeting was adjourned in
memory of former Assistant Police Chief Gerald L. "Gerry"
Constable and Trenasey Sargent.
