SUBJECT: Certification of Statement of Official Action for Appeal 98-008 of the Planning Commission=s Approval of Development Review 98-002 to Amend Conditions of Approval Stipulated in DR 91-006 to Allow Expansion of Pacific Park=s Hours of Operation, at 380 Santa Monica Pier. Applicant: Santa Monica Amusements, L.L.C. Appellant: Ellen Brennan

This report transmits for City Council certification, the Statement of Official Action for Appeal 98-008 of the Planning Commission=s approval of Development Review 98-002 to amend conditions of approval stipulated in DR 91-006 to allow expansion of Pacific Park=s hours of operation; to increase the number of holidays when the park is permitted expanded operating hours; and to allow special hours for up to 24 private events at the amusement park annually.

On February 23, 1999, the Council modified the Planning Commission=s approval of DR 98-002 to allow expansion of Pacific Park=s hours of operation; amended the holidays when the Park is permitted expanded operating hours; and approved special hours for up to 24 private events at the amusement park annually, based on the findings contained in the attached Statement of Official Action.

Budget impacts associated with providing additional Police patrol are anticipated. These impacts are addressed, however, through condition 11(e) in the attached Statement of Official Action. The applicant will be required to pay $30,000 to fund additional services prior to implementing the park=s revised operating hours. This amount will be adjusted in subsequent years to reflect cost changes for the additional Police services. These funds will accrue to a new Police Department revenue account #01-300-304-00000-0040-10000.
