SUBJECT: Recommendation to Approve the Stormwater Parcel Report Describing Each Parcel in the City and the Amount of Each Parcel=s Stormwater Management User Fee for FY 1999-2000

Introduction

This report recommends that the City Council approve the 1999 Stormwater Parcel Report pursuant to the California Health and Safety Code, Section 5473.4. which describes each parcel in the City that receives a property tax bill from the County of Los Angeles and which details the amount of each parcel=s Stormwater Management User Fee. No increase in the fee is being recommended.

Background

On July 25, 1995, City Council adopted an ordinance establishing the Stormwater Enterprise Fund. The Stormwater Management User Fee provides revenues for stormwater management activities. At that time, the L.A. County Tax Assessor=s Office was recognized as providing the most cost-effective billing process to the annual fee. Stormwater management consists of (i) periodic upgrades and replacement of the storm drain system, (ii) enforcement of local, State and Federal stormwater regulations, such as the Los Angeles County NPDES permit, the National Pollutant Discharge Elimination System of the Clean Water Act, and the City's Urban Runoff Pollution Prevention Ordinance, (iii) implementation of the Santa Monica Bay Restoration Plan and (iv) a variety of cost-effective programs, such as Best Management Practices (BMPs), aimed at reducing the volume and pollutant load of urban runoff flowing into Santa Monica Bay.

Discussion

The Stormwater Parcel Report lists all privately-owned parcels with their associated Stormwater Management User Fee. The City must submit this report to the L.A. County Tax Assessor=s Office by August 10, 1999, in order to be included on the 1999-00 tax rolls. Prior to submittal for billing, a public hearing and Council approval are required. Notification regarding a public hearing was published in the Argonaut on May 27 and will be published again on June 3, 1999. The 1999-00 Parcel Report was filed with the City Clerk on May 27, 1999, and has been available for public review since that time.

This report is based on the most accurate parcel database available for calculating the number of Parcel Billing Units (PBUs). The number of PBUs is calculated based on land use and parcel size, which are directly proportional to the amount of runoff generated by a given parcel. The proposed 1999-00 Stormwater Parcel Fee is $36 per PBU, which is the same as the current year=s rate. A summary of average Stormwater Management User Fees by land use is provided below in Table 1.

Budget/Fiscal Impact

The Stormwater Enterprise Operation is organizationally located in the Wastewater Division; reimbursement for all designated stormwater program costs are paid by the Stormwater Fund via inter-fund transfer. The total revenue estimate from the proposed fee in FY 1999-00 is approximately $ 1,252,000 and is included in the proposed FY 1999-00 budget. This revenue will be received in revenue account number 34-500-661-00000-0550-10000.

Recommendation

Staff recommends that the City Council approve the 1999 Stormwater Parcel Report describing each parcel in the City that receives a property tax bill from the Los Angeles County Tax Assessor=s Office and the amount of each parcel=s Stormwater Management User Fee.
