Introduction

This report recommends the City Council approve an Initial Study and Negative Declaration and adopt a resolution establishing Preferential Parking Zone VV for the area bounded by Santa Monica Boulevard, Centinela Avenue, Colorado Avenue and Yale Street (excluding Yale Street), and allowing restrictions to be posted on blocks within this zone where residents have submitted required petitions.

 

Discussion

The resolution establishes Preferential Parking Zone VV for the area bounded by Santa Monica Boulevard, Centinela Avenue, Colorado Avenue and Yale Street (excluding Yale Street, Yale is part of existing Zone II). The proposed parking restrictions for Zone VV are "Two-Hour Parking, 8:00 am to 5:00 pm and No Parking 5:00 pm to 8:00 a.m. Monday through Friday, and No Parking anytime Saturday and Sunday, except by permit." Parking restrictions and benefits will apply on a given block within this zone after staff has received and verified petitions as required by the Municipal Code. At this time, restrictions will only be implemented on the 1400 block of Franklin Street. All provisions applicable to preferential parking zones would apply.

The resolution also amends Exhibit A (Preferential Parking Zones) of Resolution 9344 CCS (Resolution of the City Council of the City of Santa Monica Re-Establishing Various Preferential Parking Zones) to include Preferential Parking Zone VV.

The proposed zone is a mix of multi-family and single family residences. Commercial businesses are present on Santa Monica Boulevard and portions of Colorado Avenue.

 

Background

Initially, only Franklin Street between Broadway and Colorado petitioned and qualified for the posting of preferential parking signs. However, staff recommends a larger zone be established (bounded by Santa Monica Boulevard, Centinela Avenue, Colorado Avenue and Yale Street) with the anticipation that the residents of surrounding streets may want to be included in the zone at a later date. This approach of establishing a larger zone allows those who might be affected by the regulations in the future to be aware of them and participate in their development. It has been successfully implemented in the past. By establishing a larger zone, preferential parking for adjacent streets can be implemented when petitions are received from the residents of the street without the need to proceed with the Council approval process. In addition, residents and businesses within the larger zone receives information about the proposed zone and can consider and comment on its potential consequences.

Staff conducted parking studies on Franklin Street on a Tuesday between 7:00 am and 8:00 pm, on a Thursday between 7:00 pm and 10:00 pm, and on a Saturday between 7:00 am and 3:00 pm. During the weekday, daytime hours, the average occupancy was about 53% with a peak occupancy of 69% in the early morning. After 5:00 pm, the average occupancy increases to 74% with a peak occupancy of 88%. On Saturday between 7:00 am and 3:00 pm, the average occupancy was 89% with a peak occupancy of 107% (indicating illegal parking). Vehicles associated with the Nessah Center cause the primary impact to parking in the area, although residents also comment on impacts due to employee parking and parking associated with auto repair facilities. Based upon the study results, staff recommends the parking restrictions outlined in this report, with parking restricted to residents only during the nightime, when demand is greatest, and two-hour parking during the day, to accommodate some of the need for commercial and guest parking.

 

Community and Business Meeting/Input

A community meeting was held on Wednesday, June 23, 1999 at 7:00 pm to gather input on the proposed preferential parking zone. Residents and businesses in the affected area were invited to attend and comment. For those that could not attend, written comments were also accepted.

Approximately 50 people attended the meeting, including residents and businesspersons. The major point of discussion throughout the evening was the impact attributed to the operation of the Nessah Center located at 1515-1517 Franklin Street. Planning and Community Development Department staff have provided a summary of issues and actions related to the Center as an attachment to this report. Businesses, the Chamber of Commerce and the Nessah Center were notified of and attended the meeting. One business person was very concerned about negative impacts on his business, because he has inadequate off-street parking for his employees.

By show of hands at the meeting, attendees preferred no parking except for residents, followed closely by no parking restrictions at all. Only two attendees preferred the recommendation of staff. Comment sheets submitted by people at the meeting included seven from people who wanted more restrictions than proposed, six who felt that more regulation or enforcement of Nessah Center would eliminate the need for preferential parking and one who did not want preferential parking.

Eighteen residents and seven business representatives also wrote to the City on this issue. The residents were split on whether they supported preferential parking. Those who wanted it generally lived on or close to Franklin Street and felt that the parking problems are serious. Those that were opposed did not live on Franklin Street, felt that on-street parking is generally available, and objected to having to pay fees for permits or go through the inconvenience of providing permits to guests. The businesses were all concerned about the impact of parking regulations on their businesses, particularly on the availability of customer or client parking. A petition against preferential parking in this area was signed by about 36 residents of the area as well as business representatives and employees, and submitted by Santa Monica Chevrolet. No regulations will be implemented on any street unless residents representing a minimum of 67% of the units on the street support the regulations.

Staff recognizes that preferential parking has benefits as well as drawbacks. The recommendation is intended as a compromise which balances the need for restrictions where the problem is acute against the negative consequences of very restrictive regulations throughout the neighborhood. The greatest benefit will be to those who are disrupted nights and evenings by parkers and noise associated with parkers. Businesses without long-term employee parking, or those with clients and customers who typically spend more than two-hours on site, or come in the evenings, may be the most negatively affected. It may be possible to modify meter hour and time limit restrictions on the commercial parking to address these problems on a location by location basis.

An alternative evaluated was provision for employee parking on the street, but employee parking does not appear to be a serious problem for a significant number of businesses in the area.

 

Environmental Review

An initial study was prepared for the proposed parking zone in accordance with the provisions of the California Environmental Quality Act. Based upon the initial study, a negative declaration has been prepared. All documents are attached to this Staff Report. Notice of preparation of the negative declaration was given in the manner required by law.

 

Implementation Schedule for Preferential Parking Zone VV

Staff anticipates that Preferential Parking Zone VV will be implemented and enforcement initiated within 45 to 60 days after Council approval. The majority of this time is required to notify residents on the procedures and rules and regulations to obtain permits, and to issue the permits.

Preferential parking signs will be installed within a week prior to the designated start date of enforcement.

 

Budget/Fiscal Impact

Initially, it is estimated that approximately 200 permits will be purchased by area residents in the proposed zone. This will generate approximately $3,000 annually in additional revenue in FY 99/00 at account 01415.400290. The preferential parking signs will be installed by City crews.

 

Recommendation

It is recommended that the City Council:

  1. Approve the negative declaration for the proposed zone.
  2. Approve the attached Resolution establishing Preferential Parking Zone VV and Amending Resolution 9344 CCS (Resolution of the City Council of the City of Santa Monica Re-Establishing Various Preferential Parking Zones) by replacing Exhibit A.
  3. Direct Finance Department staff to make the budget adjustments outlined in this report.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

SANTA MONICA ESTABLISHING PREFERENTIAL PARKING

ZONE VV AND AMENDING RESOLUTION NUMBER 9344 (CCS) BY REPLACING EXHIBIT A

 

 

WHEREAS, the Parking and Traffic Engineer has received a petition requesting the establishment of a preferential parking zone; and

WHEREAS, the petition has been verified to be signed by residents living in two-thirds of the dwelling units comprising not less than fifty percent (50%) of the developed frontage of the proposed preferential parking zone; and

WHEREAS, the Parking and Traffic Engineer has undertaken such studies and surveys deemed necessary to determine whether a preferential parking zone should be designated in the above area; and

WHEREAS, the Planning Division has prepared the required Initial Study and Negative Declaration; and

WHEREAS, the City Council hereby finds that the proposed area meets the designation criteria set forth in Municipal Code Section 3.08.040,

NOW THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MONICA RESOLVES AS FOLLOWS:

Section 1. Preferential Parking Zone VV is hereby established. The regulations for Preferential Parking Zone VV are as follows:

(a)The following named and described streets within the City shall constitute Preferential Parking Zone VV: the area bounded by Santa Monica Boulevard, Centinela Avenue, Colorado Avenue and Yale Street (excluding Yale Street).

(b)No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone VV for more than two hours between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, and no vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone VV between the hours of 5:00 p.m. and 8:00 a.m., Monday through Friday, or anytime, Saturday and Sunday.

(c) Preferential parking restrictions shall be posted in each eligible block within the zone upon receipt and verification of a qualifiying petition representing two-thirds of the dwelling units and at least 50% of the abutting frontage.

(d)Any vehicle parked or stopped without a permit when required by this Section may be removed from the street by any police officer. (e)The annual fee for each permit issued for Preferential Parking Zone VV shall be $15.00 per permit, or such other fee as may be established from time to time by resolution of the City Council.

Section 2. Exhibit A to Resolution 9344 Number 9344 (CCS) is deleted in its entirety and replaced by Exhibit A attached to this Resolution.

Section 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.

    (b) No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone CC between the hours of 9:00 a.m. and 9:00 p.m. daily.

    Zone DD

    (a) The following named and described streets within the City shall constitute Preferential Parking Zone DD:

    1. 24th, 25th and 26th Streets between Pico Boulevard and Pearl Street

    2. Pearl Street between Cloverfield Boulevard and 26th Street

    3. 24th Street north of Ocean Park Boulevard to Grant School

    (b) No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone DD as follows:

    (1) On 24th, 25th, and 26th Streets between Pico Boulevard and Pearl Street, for more than two hours between the hours of 8:00 a.m. and 6:00 p.m. daily, except that on 24th Street between Pico Boulevard and Pearl Street north of the midpoint, as determined by the City Parking and Traffic Engineer, between the alley south of Pico Boulevard and the alley north of Pearl Street, no parking shall be permitted between the hours of 8:00 a.m. and 6:00 p.m. daily.

    (2) On Pearl Street between Cloverfield Boulevard and 26th Street, and 24th Street north of Ocean Park Boulevard to Grant School, for more than two hours between the hours of 8:00 a.m. and 6:00 p.m. Monday through Friday.

    Zone VV

    (a) The following named and described streets within the City shall constitute Preferential Parking Zone VV:

    The area bounded by Santa Monica Boulevard, Centinela Avenue,

    Colorado Avenue and Yale Street (excluding Yale Street)

  5. No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone VV for more than two hours between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, and no vehicle shall be parked or stopped adjacent to any curb between the hours of 5:00 p.m. and 8:00 a.m. Monday through Friday, or anytime, Saturday and Sunday.
  6. These regulations shall become effective on each street within the named and described Zone following receipt and verification of petitions pursuant to Santa Monica Municipal Code Section 3.08.050 and posting of signage to that effect by the Traffic Operations Division.
