SUBJECT: Award of Construction Contract for Three Playgrounds at Clover, Marine and Ozone Parks to Pima Corporation; Recommendation to Authorize the City Manager to Negotiate and Execute a Construction Management Contract with Black and Veatch

Introduction

This report recommends that the City Council award a construction contract to Pima Corporation, the lowest responsible bidder, in the amount of $622,450 for construction of three playgrounds at Clover, Marine and Ozone Parks and approve $93,370 in contingency funds for this contract. This report also recommends that the City Council authorize the City Manager to negotiate and execute a contract with Black and Veatch Construction, Inc. in an amount not to exceed $100,000 for construction management and approve $15,000 in contingency funds for this contract.

Background

On January 14, 1997, City Council awarded a contract to Rios Associates for preparation of design drawings and construction documents for the renovation of Douglas Park and children's play areas in four City parks. Council reviewed and approved the Schematic Design on March 3, 1998. The three playgrounds at Clover, Marine and Ozone Parks are being replaced with new accessible play equipment, features and paths. Clover Park will also have an artist-designed custom climbing structure and painted runways. Douglas Park and Joslyn Park playgrounds are being renovated under separate contracts.

Discussion

A Notice Inviting Bids for the construction contract was published on September 30 and October 7, 1999 in the The Argonaut and The Green Sheet. Bid documents were sent to twelve women/minority business enterprise associations (WMBE). Bidding packages were requested by 15 contractors. The City Clerk's office received 11 sealed bids which were publicly opened and read aloud on October 18, 1999 by the Deputy City Clerk. The results were:

The lowest responsible bidder, Pima Corporation of Santa Monica, supplied the City with the names of recent similar projects, including Kenneth Hahn State Park, Gunn Avenue Park, and Thomas Burton Park for the County of Los Angeles Department of Public Works, Dr. Richard Rioux Memorial Park for the County of Los Angeles Department of Parks and Recreation, Rancho Madera Community Park for the Rancho Simi Recreation and Park District, and gateway entry monument and bikeway construction for the City of San Fernando. City staff contacted representatives of the agencies representing these projects and all respondents reported that the Contractor's work was satisfactory. City staff also contacted representatives from the cities of Manhattan Beach and Hermosa Beach to follow-up on additional references not provided by the Contractor. Both additional references reported that Pima Corporation's work was satisfactory.

The State Contractors' License Board verified that the Contractor's license is current, active, and in good standing. City staff also verified the good standing of each major subcontractor listed by the Contractor. Construction is scheduled to begin in January, 2000 and is estimated to be completed within nine months.

A Request for Qualifications for construction management services was distributed on June 23, 1999 to seven firms. Three responses were received and reviewed by a committee that included representatives from the Community and Cultural Services Department and the Public Facilities Maintenance and Engineering Divisions of the Environmental and Public Works Management Department. The review committee recommended Black & Veatch Construction, Inc. for the construction management services for this project. Black & Veatch is currently providing similar services for the City of Santa Monica's Beach Improvement Group (BIG) Project, Santa Monica Urban Runoff Recycling Facility and Douglas Park Improvements. Their performance on all projects has been excellent.

Recommendation

Staff recommends that the City Council:

1. Award a construction contract for the three playgrounds at Clover, Marine and Ozone Parks to Pima Corporation , the lowest responsible bidder, in the amount of $622,450 and approve $93,370 in contingency funds for this contract; and

2. Authorize the City manager to negotiate and execute a contract with Black and Veatch Construction, Inc. in an amount not to exceed $100,000 for construction management services for the three playgrounds at Clover, Marine and Ozone Parks and approve $15,000 in contingency funds for this contract; and

3. Authorize the City Engineer to issue any necessary change orders to complete additional work in conformance with the Administrative Instructions on change orders and within budget authority.
