SUBJECT: Recommendation to Authorize the City Manager to Negotiate and Execute a Professional Services Contract with National Access Consultants, LLC for Americans with Disabilities Act and Guidelines Consulting Services.
INTRODUCTION
This report recommends that the City Council authorize the City Manager to negotiate and execute a professional services contract with National Access Consultants, LLC for Americans with Disabilities Act and Guidelines (ADAAG) Consulting Services in an amount not to exceed $49,050 and contingency funds not to exceed $7,400.
BACKGROUND
ADAAG prohibits discrimination in all services, programs and activities provided by, or made available by State and Local governments. To the maximum extent feasible, facilities and public spaces must be accessible and useable by individuals with a variety of disabling conditions.
The City is currently implementing and planning ADAAG improvements at numerous City owned facilities. The consultant will participate in the development of the project design by reviewing construction documents including plans and specifications to insure compliance with all current applicable ADAAG and Title 24 requirements. In keeping with the Citys leadership role in this area, the consultant will also assist in determining when access exceeding the minimum mandated by the regulations should be provided.
The projects addressed by the consulting services will be Airport Park Expansion (schematic design), Branch Library Improvements, Main Library Expansion (schematic design), Building Improvements, Parking Structure Lobby Upgrades, Parking Structure Number 5 Seismic Upgrade, and Virginia Avenue Park Expansion.
Selection Process
Requests for Proposals were sent to five firms. A four member selection committee comprised of City staff from the Environmental and Public Works Management and Community and Cultural Services Departments interviewed two firms. Based upon the proposals, interviews, and reference checks, staff recommends National Access Consultants (NAC) for the project. NAC is a multi-disciplinary consulting firm which brings design, legal, and technical expertise to address the complex interplay of state and federal disabled access laws and whose mission is to provide access while minimizing liability. NAC has ongoing consulting services of a similar nature with the County of Orange and the Office of the California Attorney General. They have advised many design firms including Sasaki Associates and Coleman Caskey Architects on Park Service and State University projects. All reference checks stated that the consultant

RECOMMENDATION
1. Authorize the City Manager to negotiate and execute a professional services contract with National Access Consultants, LLC for Americans with Disabilities Act and Guidelines (ADAAG) Consulting Services in an amount not to exceed $49,050 and approve $7,400 in contingency funds.
2. Authorize the City Engineer to prepare any modifications to the contract needed within the budget authority.
