SUBJECT: Recommendation to Adopt a Resolution Authorizing the City Manager to Execute an Agreement with the State of California, Department of Transportation, for State Transportation Improvement Program (STIP) Grant Funding

Introduction

This report recommends that the City Council adopt a resolution authorizing the City Manager to execute an agreement with the State of California, Department of Transportation, for State Transportation Improvement Program (STIP) grant funding for pavement rehabilitation, concrete sidewalk rehabilitation, curb and gutter repair, and reconstruction of retaining wall on Appian Way between Moss Avenue and Seaside Terrace.

Background

The retaining wall on the east side of the 1640 beach parking lot (aka, the "Hot-Dog-on-a Stick" lot) between Moss Avenue and Seaside Terrace was constructed prior to 1940. Due to damage suffered during the 1997-98 El Nino storms, it was necessary to install temporary steel bracing to a portion of the retaining wall in 1998 during construction of the Moss Avenue Pumping Station to prevent collapse of the wall from heavy equipment loadings on Appian Way. The estimated cost to replace the retaining wall is $625,000, inclusive of design, construction and construction management.

Originally, it was anticipated the City would have to bear the full cost of replacement of the retaining wall. However, last year, the City applied for and was awarded a STIP grant of $428,000 toward construction of the retaining wall and repair of adjacent roadway and sidewalk.

Discussion

Following approval of the STIP grant, the State Department of Transportation prepared a master agreement between the City and the State describing conditions for administering the project. The agreement has been reviewed by City staff and found to be acceptable. The City is required to provide the State with a copy of a Council Resolution which clearly authorizes the City Manager to execute the agreement.

Budget/Financial Impact

The revenue is reflected in FY 2000-2001 capital budget revenue account 20402.406410. Construction of this $625,000 project is anticipated to commence in the second half of 2001. Proposed 2001-2002 capital budget account C11065802.58900 reflects expenditures of $472,000 for this project. The Department requests an additional appropriation of $153,000 to the FY 2000-01 Capital Improvement Project Budget for the remaining funding needed for this project. This appropriation would be placed in account C11065801.58900.

Recommendation

Staff recommends that the City Council:

1. Adopt a resolution authorizing the City Manager to execute an agreement with the State of California, Department of Transportation, for State Transportation Improvement Program (STIP) grant funding of pavement rehabilitation, PCC

sidewalk rehabilitation, curb and gutter repair, and reconstruction of retaining wall on Appian Way between Moss Avenue and Seaside Terrace, in an amount of $428,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

SANTA MONICA AUTHORIZING THE EXECUTION BY THE

CITY MANAGER OF THE MASTER AGREEMENT - ADMINISTERING

AGENCY - STATE AGREEMENT FOR STATE FUNDED PROJECTS

WHEREAS, the State of California (AState@) has made State funds available for use on local transportation facilities; and

WHEREAS, the City of Santa Monica (ACity@) has applied to the California Transportation Commission (ACTC@) and/or the State for funding from the State Transportation Improvement Program (ASTIP@), or other programs, as defined in the Local Assistance Program Guidelines for use on local transportation facilities as locally administered projects; and

WHEREAS , the City has been granted STIP funding for the reconstruction of the Appian Way retaining wall damaged in the El Nino storms (AProject@);

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The City Manager of the City of Santa Monica is hereby authorized to execute the Master Agreement - Administering Agency - State Agreement for State Funded Projects (Agreement No. 000107)(AAgreement@) for State funding for the Project;

SECTION 2. The City Manager of the City of Santa Monica, or her designee, is hereby authorized to execute any applicable Program Supplement to the Agreement, which is necessary to implement the terms of the Agreement.

SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
