SPECIAL MEETING - CITY COUNCIL MINUTES

FEBRUARY 15, 2005

A special meeting of the Santa Monica City Council was called to order at 7:01 p.m., on Tuesday, February 15, 2005, at City Council Chambers, 1685 Main Street.

Roll Call: Present: Mayor Pam O=Connor (arrived at 7:07 p.m.)

Councilmember Richard Bloom

Councilmember Ken Genser

Councilmember Robert T. Holbrook

Councilmember Kevin McKeown

Councilmember Bobby Shriver (arrived at 7:16 p.m.)

Absent: Mayor Pro Tem Herb Katz

City Clerk Maria M. Stewart

CONVENE/PLEDGE

On order of the City Clerk, with a majority of Councilmembers present, and with Mayor O=Connor and Mayor Pro Tem Katz absent, the special City Council meeting convened at 7:01 p.m., with Councilmember Shriver also absent. Assistant City Attorney Joe Lawrence led the assemblage in the Pledge of Allegiance.

The City Clerk opened the floor for nomination for a temporary Chair.

Motion by Councilmember Bloom, seconded by Councilmember McKeown, to appoint Councilmember Genser as temporary Chair. The motion was unanimously approved, with Mayor O=Connor, Mayor Pro Tem Katz, and Councilmember Shriver absent.

There being no one present for public comment, on order of Temporary Chair Genser, the City Council adjourned to consider closed sessions at 7:03 p.m.

Mayor O=Connor arrived at 7:07 p.m.

CLOSED SESSIONS

2-A: Conference with Legal Counsel B Existing Litigation: Larry Verbit v. City of Santa Monica, Case No. SC 078 812.

ACTION: Heard. No action taken.

Councilmember Shriver arrived at 7:16 p.m.

2-B: Conference with Legal Counsel B Existing Litigation: City of Santa Monica v. Baron & Budd, P.C., Case No. BS 315 186.

ACTION: Not heard.

2-C: Conference with Legal Counsel B Existing Litigation: Feldman v. City of Santa Monica, Case No. CV 04-1152 SVW (CWx).

ACTION: Heard. No action taken.

2-D: Conference with Legal Counsel B Existing Litigation: City of Santa Monica v. Maria Stewart, Case No. SC 067 033.

ACTION: Heard. No action taken.

2-E: Conference with Legal Counsel B Anticipated Litigation. Anticipate significant exposure to litigation pursuant to Government Code Section 54956.9(b): two potential cases related to real property located at 1267 Pacific Coast Highway, and 1007 Pier Street.

ACTION: One case heard related to 1007 Pier. No action was taken.

2-F: Public Employee Evaluation.
