Subject:          Modification to Contract No. 8617 (CCS) with Fleming Environmental, Inc. for Additional Underground Storage Tank Upgrades

 

Recommended Action

Staff recommends that the City Council authorize the City Manager to execute a modification to Contract No. 8617 (CCS) with Fleming Environmental, Inc., in an amount not to exceed $8,872 to provide additional improvements to the underground storage tank systems  at various City Operations.

 

Executive Summary

In addition to serving as the local agency for the underground storage tank program implemented City-wide, the City is also the owner and operator of 17 underground tanks at eight locations within the City.  Since the Contract No. 8617 (CCS) was executed on September 11, 2006, the Environmental Programs Division and contractor identified enhancements to the monitoring equipment proposed for Fire Stations #1, #2, and #5, and the Corporate Yard to assist City staff in operation of their respective tank systems.  In addition, construction related improvements were also identified after the contract was awarded; specifically, the dispensing operations at Fire Station #1, piping replacement at Fire Station #3, and installation of electrical conduit at Fire Station #5.  These improvements, while not mandated, will provide better fueling and avoid potential repair and/or replacement in the future.  The recommended Council action will authorize  new contract authority with Fleming Environmental, Inc. in the amount of $417,770.  Funds in the amount of $8,872 for this contract modification are available in the Underground Tank Management CIP account number C010020.589000.

 

Discussion

Background

On July 25, 2006, the City Council approved Contract No. 8617 (CCS) with Fleming Environmental, Inc., to provide various underground storage tank improvements at City-owned facilities in the amount of $371,725 plus a 10% contingency of $37,173 for a total cost not to exceed $408,898.  During implementation of the approved modifications, additional upgrades were identified to provide a higher standard of electronic monitoring at Fire Stations #1, #2, and #5, and at the Corporate Yard in addition to providing consistency among City operations.  The dispensing equipment at Fire Station #1 was relocated to better utilize space in the back lot and improve fueling operations.  Existing electrical conduits were not able to be used during tank modifications at Fire Station #5; therefore, new conduits were installed.  Also, new piping associated with the emergency generator at Fire Station #3 is proposed to be installed.  The 10% contingency originally awarded is not enough to cover the cost of these items, requiring an increase to the contract of $8,872 for a new total not to exceed amount of $417,770.

 

 

Budget/Financial Impact

Funds in the amount of $8,872 are available in the Underground Tank Manage CIP account number C010020.589000.
