Recommended Action
Staff recommends that the City Council authorize the City Manager to negotiate and execute a professional services agreement with Roesling Nakamura Terada Architects for design services for the development of beach restroom facilities in the amount of $263,196 plus a 10% contingency for a total amount not to exceed $289,516.

Background
In December 2005, the City received
notification from the California Department of Parks and Recreation (State
Parks) that it had been defending a class action lawsuit filed under
On March 23,
2006, City Council members received an Information Item providing
background on the City’s participation in a Consent Decree. Based on review of the Consent Decree and an
assessment of the costs and benefits, the City Attorney recommended that the
City participate in the Decree.
Subsequently, the City Manager signed and forwarded a letter to State
Parks acknowledging that the City would participate in the Decree. The City considered the option of participating
in the Consent Decree or opting out. Since the City has a long-standing
commitment to accessibility, the City chose to participate in the Consent
Decree and the City will also receive the protection against future litigation.

Funding for
design and construction is currently appropriated in the Capital Improvement
Program (CIP) budget.
In order to complete construction within the timeline set forth in the consent decree and also minimize impacts on the public due to the loss of restrooms during construction, a two phase construction process is recommended where only four restroom locations are under construction at any given time (during the non-peak beach season of October through April in the coming two years). This requires a streamlined design and review process during the coming months in order to be ready for the first phase construction period beginning in October 2008.
Consultant Selection
A Request for Proposals was issued for design services for the development of a beach restroom facilities and a feasibility study on expanded beach lifeguard facilities. The feasibility study was removed from the scope of work due to lack of funding to fully implement lifeguard facility improvements. The Request for Proposals was sent to 25 firms and was advertised on the Civil Engineering and Architecture Division’s website. Five proposals were received. A selection committee comprised of representatives from Environmental and Public Works Management- Architectural Services, Community and Cultural Services, and Community Maintenance reviewed the five proposals. Selection criteria included direct experience on similar projects, staffing efficiency, cost of services, technical competence, understanding of the project’s scope, approach to the work, qualification of proposed staff, and the ability to meet required time frames. Interviews were conducted followed by a site visit to the built work of the recommended consultant.

public restrooms. Relevant project
experience includes: development of restrooms, lifeguard station, and the
community building at
Public Outreach
The public outreach and project review schedule has
been developed in consideration of two significant factors: (1) the need to be
in compliance with the consent decree in 2010, and (2) the need to minimize the
impact on the beach-going public during the peak season of May through
September. In light of these factors,
staff recommends the following process for public and Council review of the
design direction for the project. Following finalization of negotiations and
execution of the contract, the design team will dedicate approximately one
month developing several conceptual approaches to the project based on
successful prototypes for public restrooms that have been constructed at various
park sites in recent years (i.e., Douglas, Palisades and
