Council Meeting Wrap-Up

Mayor O’Connor announced the Community Workshop on Gang Violence to be held Saturday, February 26, from 9 a.m. to 1 p.m., at John Adams Middle School, encouraging members of the community to attend (more information is available at http://www.smgov.net/residents/StopGangs.htm).

CONSENT CALENDAR  Among matters not requiring extensive discussion, Council approved the following:  minutes of the January 25 Council meeting, as amended to reflect Council comments; contracts with Moore Iacofano Group to facilitate the community outreach program and Keyser Marston Associates to perform a financial analysis for the proposed redevelopment of Santa Monica Place; amendments to contracts with Keyser Marston to complete the new development-child care nexus study and with ROMA Design Group for additional services related to Downtown development design standards; purchase of a new aerial fire ladder truck; the city’s investment policy for 2005-06; acceptance of $82,000 in homeland security grant funds to be used to replace the alert/notification system in each city fire station and the fire training facility; a licensing agreement with the Los Angeles ERUV Committee regarding creation of a coastal designation for the exercise of religious freedom; and authorization for the City Manager to execute memoranda of understanding with three city employee bargaining units.

CLOSED SESSION  After closed session discussion, Council approved in open session a trip and fall case settlement for $45,000 and a civil rights case settlement for $75,000.  The Council voted to petition the California Supreme Court for review of a recent Appellate Court decision on the campaign contribution-related Oaks Initiative, a decision that went against the cities of Santa Monica and Pasadena on procedural grounds rather than the constitutional merits of the case.  Council directed that a discussion of the initiative, approved by Santa Monica voters as Prop. LL in 2000, and why it is being challenged as unconstitutional be agendized for an upcoming Council meeting.

ORDINANCES  The Council held second reading and adopted an ordinance to permit restaurants with more than 50 seats in the C2 District adjacent to Ocean Park Boulevard between 25th Street and Centinela Avenue, subject to approval of a CUP.  The Council held first reading on:

  • An ordinance creating $11.50/hour minimum wage requirements applicable to city contractors, with direction for staff to return with a financial analysis of costs to the city.

  • An ordinance eliminating the numerical cap on restaurants in the Bayside District/Downtown and expanding the types of establishments that can conduct alcohol sales in Bayside/Downtown, directing staff to return quickly with a process for periodic inspection for compliance and an accompanying fee schedule and to notify applicants that there is such a process in development.

  • An ordinance clarifying that fees may be collected on behalf of the city by the Pier Restoration Corporation and the Bayside District Corporation.

APPOINTMENTS  The Council appointed Father Mike Gutierrez to the Housing Commission.  Other appointments were continued. 

ADJOURNMENT  Council adjourned in memory of Mildred Kiros, wife of Dr. George Kiros, a long-time resident of Santa Monica who recently passed away.

NOTE:  Item 6-A on the agenda will be re-noticed and continued to a future meeting, at the appellant’s request, and Item 8-A regarding a development agreement was withdrawn by staff.
