                 A RESOLUTION OF THE PLANNING COMMISSION
                       OF THE CITY OF SANTA MONICA
             DECLARING ITS INTENTION TO RECOMMEND AMENDMENT 
           OF THE COMPREHENSIVE LAND USE AND ZONING ORDINANCE
                       OF THE CITY OF SANTA MONICA


          WHEREAS, the City Council held a public hearing on May
24, 1994 to hear public testimony prior to the adoption of Interim
Ordinance No. 1745 which regulated the sale, lease or transfer of
firearms and munitions; and

          WHEREAS, the City Council held a public hearing on August
9, 1994 to hear public testimony prior to adoption of Interim
Ordinance No. 1763 which replaced Interim Ordinance No. 1745 and
further regulates the sale, lease or transfer of firearms and
munitions

          NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS:


SECTION 1.  Pursuant to the Santa Monica Municipal Code Section
9.04.20.16.020, the Planning Commission does hereby give notice of
its intention to recommend amendment of the Comprehensive Land Use
and Zoning Ordinance of the City of Santa Monica as set forth in
Exhibit A, attached to this Resolution.

SECTION 2.  The Planning Director shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

AMENDMENTS TO COMPREHENSIVE LAND USE AND ZONING ORDINANCE 
OF THE CITY OF SANTA MONICA
        




Section 9.04.02.030 Definitions.

add: Firearms dealership:  any business which sells, transfers,
leases or offers or advertises for sale, transfer or lease any
firearm or munitions.


add: Section 9.04.14.130 Firearms dealerships.
     
     The purpose of this Section is to ensure that firearms
dealership operations do not adversely impact adjacent areas.  The
Planning Commission, or City Council on appeal, may approve the use
of a property for a business or use which sells, transfers, leases,
offers or advertises for sale, transfer or lease any firearm or
munitions in any location where such business is permitted if the
following findings can be made in an affirmative manner:

     a.   The proposed use will not adversely affect the welfare of
nearby neighborhood residents in a significant manner.
     
     b.   The proposed use will not contribute to an undue
concentration of similar uses.

     c.   The proposed use will not detrimentally affect nearby
neighborhoods, considering the distance of the use and visibility
from residential buildings, churches, schools, hospitals,
playgrounds, parks, day care facilities and other existing similar
uses.

     d.   The proposed use is compatible with existing and
potential uses within the general area.

     e.   The public health, safety and general welfare are
protected.

     f.   No harm to adjacent properties will result.
