Street. Application for Conditional Use Permit (CUP)
00-030 to allow the continued use of an existing nonconforming neighborhood
grocery store in a residential district. The conditional use permit that
allowed the nonconforming neighborhood grocery store to operate for a limited
term has expired, and a new permit is required. Approval would require the
Planning Commission to modify special conditional use permit standards for
neighborhood markets pursuant to pending Text Amendment 03-004. (Planner: Bruce

7-B. Conditional Use Permit
00-009, 2225 Fourth Street. Application for Conditional Use
Permit (CUP) 00-009 to allow the continued use of an existing nonconforming
neighborhood grocery store in a residential district. The conditional use
permit that allowed the nonconforming neighborhood grocery store to operate for
a limited term has expired, and a new permit is required. The applicant also
requests amending restrictions on the store’s operating hours pursuant to
Condition 9 of CUP 381and Condition 1 of Parcel Map 18025 and CUP 435 which
requires the market building to be removed.
Approval would require the Planning Commission to modify special
conditional use permit standards for neighborhood markets pursuant to pending

8-A. Conditional Use Permit 02-027, 3205 Ocean
Park Boulevard. To allow
the conversion of an existing 1,309 square-foot tenant space from general
office use to medical office. Medical offices require a CUP in the C2
(Neighborhood Commercial) Zone, provided that the use does not exceed 25% of
the total square footage of the building or 3,000 square feet, whichever is

Use Permit 02-029, 1147 Third Street. Application for

8-C. Zone Change 02-036, Text Amendment 02-007, and Conditional
Use Permit 02-009, 2800 Lincoln Boulevard. Applications to allow a Zone Change, Text Amendment
and a Conditional Use Permit to rezone an OP2 lot to an OP2A designation and to
amend Santa Monica Municipal Code Section 9.04.08.38.050 to allow canopy
structures, temporary parking and wipe-down areas in support of existing car
wash operations in the “A” overlay district, subject to a Conditional Use

8-D. Text Amendment 03-007, Citywide. Amendment of Santa Monica Municipal
Code Section 9.04.20.16.060(a) to establish that the initial term of an interim
ordinance shall be for 60 days from the ordinance’s effective date. Section
9.04.20.16.060(a) currently provides that the initial term of an interim

Discussion and adoption of a policy prohibiting ex parte meetings and other forms of lobbying Commissioners by interested parties outside of public view for quasi-judicial items that appear before the Commission, to establish rules and procedures for the transmittal of written materials and e-mails from interested parties regarding quasi-judicial items and give direction to staff to prepare language to amend the Commission rules to carry out these policies. Requested by Commissioners Johnson and Olsen via e-mail on August 27, 2002. Continued from April 2, 2003.
9-C. Discussion on the merits
and practicality of initiating a text amendment to eliminate the sign code and
all rules and regulations related to signs. Requested by Commissioner Olsen via

9-D. Discussion
on developing guidelines requiring open courtyards for projects that are
situated on more than one lot in multi-family residential districts. Requested

AGENDA POLICIES
The Planning Commission considers a
range of requests for development permits, appeals, and planning policy
matters, and conducts public hearings on many of its agenda items. Due to the
number, complexity and public interest associated with many agenda items,
meetings of the Commission are generally lengthy. The Commission makes every
effort to proceed as expeditiously as possible; your patience and understanding
is appreciated.
REQUESTS TO SPEAK on an item must be submitted on a
speaker's request form and submit it to the Commission secretary. All requests
to address the Commission on public hearing items must be submitted prior
to the Commission's consideration of the item.
CONSENT CALENDAR items will be acted upon by the
Commission at one time without discussion unless a Commissioner requests
discussion on an item or a member of the public has submitted a request to
speak on an item. If such a request is
made, the item will be heard after the balance of the Consent Calendar has been
voted upon.
PUBLIC HEARING PROCEDURES on each public hearing item include
presentation of a staff report; Commission questions of staff; a fifteen
minutes presentation by the project applicant or applicant’s representative or
team, if any; Commission questions of the applicant; four minutes for each
member of the public wishing to speak to the item; three minutes for project
applicant to respond to the public or clarify issues raised by the public;
Commission deliberations and decision.
PRESENTATIONS BY MEMBERS OF THE
PUBLIC should begin
with the speaker stating his or her name and address followed by a statement
regarding the item under consideration.
Please speak to the Commission as a whole.
PROFESSIONALS APPEARING BEFORE THE
COMMISSION should
clearly identify their status, such as "attorney",
"paralegal", "architect", "designer", or
"landscape architect".
Instances of misrepresentation of professional status may be referred to
the City Attorney for possible prosecution.
LETTERS OR WRITTEN MATERIALS regarding agenda items may be
submitted to the City Planning Division staff prior to or at the Commission
meeting; written materials submitted in advance of the meeting will be given to
the Commission on the night of the public hearing.
ASSIGNING OF TIME for members of the public wishing
to speak to an item is permissible within specified limits. A "representative speaker" may be
allowed one additional minute of speaking time, to a maximum of five additional
minutes (hence, nine minutes total) for each person actually in attendance who
assigns his or her right to speak via a request to speak form to the
"representative speaker."
ACTION BY THE PLANNING COMMISSION on most matters occurs with the
affirmative votes of at least four Commissioners.
DESIGN ASPECTS OF PROJECTS considered by the Planning
Commission must also be approved by the Architectural Review Board. For more information on this process,
contact the City Planning Division.
APPEALS of certain actions of the
Commission are appealable to the City Council.
