HEARING: WORKSHOP
8-A. Workshop to consider possible amendments to the Substantial Remodel definition contained in the City’s Zoning Ordinance (SMMC 9.04.02.030.825). This definition sets forth criteria that requires existing nonconforming structures and uses be brought into compliance with current zoning regulations when substantially remodeled. The workshop is intended to allow the public an opportunity to provide comment on text, application and interpretation of this definition and to allow the Planning Commission to comment and provide direction regarding possible amendments to the definition. No action to adopt an interpretation or change the definition will occur at this hearing. There is no staff report for this workshop. [Planner: Jonathan Lait, AICP]

9-A. Conditional Use
Permit 03-009, 2445 Santa Monica Boulevard.
A Conditional Use Permit (CUP) to upgrade and allow the
legal-nonconforming automobile repair facility to expand the service area of an
existing new car dealership. The
two-story auto repair facility has seven (7) service bays and 2,240 square feet
of non-bay floor area. The adjacent parking lot has 11 parking spaces. The facility is used to service new and used
cars for the Volkswagen Dealership that is located across Santa Monica
Boulevard. The existing Volkswagen Dealership is not included in this
application. The proposal complies with
requirements for existing legal-nonconforming auto repair facilities. [Planner:

Amendment Adding
Zoning Ordinance Sections 9.04.02.030.778 and 9.04.14.140 and amending Sections
9.04.08.15.040, 9.04.08.18.040, 9.04.08.20.040, 9.04.08.22.040, and
9.04.08.26.040 regarding short-term rental housing. LOCATION: BSCD, C3, C3-C, C4, and C6 Districts. The
Planning Commission will conduct a public hearing to consider a text amendment
that would add a Zoning Ordinance section to create a definition of short-term
rental housing and a section to set forth special conditions for short-term
rental housing. In addition, the BSCD,
C3, C3-C, C4, and C6 sections of the Zoning Ordinance would be amended to allow
short-term rental housing as a conditionally permitted use. Additionally, the
Planning Commission may consider recommendations that short-term housing should

AGENDA POLICIES
The Planning Commission considers a
range of requests for development permits, appeals, and planning policy
matters, and conducts public hearings on many of its agenda items. Due to the
number, complexity and public interest associated with many agenda items,
meetings of the Commission are generally lengthy. The Commission makes every
effort to proceed as expeditiously as possible; your patience and understanding
is appreciated.
REQUESTS TO SPEAK on an item must be submitted on a
speaker's request form and submit it to the Commission secretary. All requests
to address the Commission on public hearing items must be submitted prior
to the Commission's consideration of the item.
CONSENT CALENDAR items will be acted upon by the
Commission at one time without discussion unless a Commissioner requests
discussion on an item or a member of the public has submitted a request to
speak on an item. If such a request is
made, the item will be heard after the balance of the Consent Calendar has been
voted upon.
PUBLIC HEARING PROCEDURES on each public hearing item include
presentation of a staff report; Commission questions of staff; a fifteen
minutes presentation by the project applicant or applicant’s representative or
team, if any; Commission questions of the applicant; four minutes for each
member of the public wishing to speak to the item; three minutes for project
applicant to respond to the public or clarify issues raised by the public;
Commission deliberations and decision.
PRESENTATIONS BY MEMBERS OF THE PUBLIC should begin with the speaker
stating his or her name and address followed by a statement regarding the item
under consideration. Please speak to
the Commission as a whole.
PROFESSIONALS APPEARING BEFORE THE
COMMISSION should clearly
identify their status, such as "attorney", "paralegal",
"architect", "designer", or "landscape
architect". Instances of
misrepresentation of professional status may be referred to the City Attorney
for possible prosecution.
LETTERS OR WRITTEN MATERIALS regarding agenda items may be
submitted to the City Planning Division staff prior to or at the Commission
meeting; written materials submitted in advance of the meeting will be given to
the Commission on the night of the public hearing.
ASSIGNING OF TIME for members of the public wishing
to speak to an item is permissible within specified limits. A "representative speaker" may be
allowed one additional minute of speaking time, to a maximum of five additional
minutes (hence, nine minutes total) for each person actually in attendance who
assigns his or her right to speak via a request to speak form to the
"representative speaker."
ACTION BY THE PLANNING COMMISSION on most matters occurs with the
affirmative votes of at least four Commissioners.
DESIGN ASPECTS OF PROJECTS considered by the Planning
Commission must also be approved by the Architectural Review Board. For more information on this process,
contact the City Planning Division.
APPEALS of certain actions of the
Commission are appealable to the City Council.
