The Santa Monica Municipal Code sets forth guidelines for home enterprises in residential districts. The purpose of Section 9.04.20.04 (Home Occupation permits) is to allow persons who reside in a residential district the opportunity to initiate a business enterprise while maintaining the residential character of the neighborhood, ensuring that surrounding residents' enjoyment of their neighborhood and property will not be diminished.

Please read the following statements carefully. This permit requires that the applicant fully understand and abide by the terms of this agreement.



1.Please provide a brief description of how the business operates at your residence (i.e. the general nature of the business, what you do on-site, the hours of operation).

2.A home occupation must be conducted indoors within a dwelling or accessory building with the exception of horticulture activities which may be conducted out of doors within the rear one-half of the parcel.

If your business entails gardening or horticulture type activities, please describe the nature of the activities you will be conducting at the residence, the type of materials you will store, and where you will conduct the business on the premises.

3.You may not use the garage or carport for the operation of your business. A garage or carport must be maintained for use of automobiles and similar type vehicles.

I understand that the garage (carport) will be maintained for vehicle parking and I agree that the establishment of this business will in no way hinder this stated purpose.

4.The home enterprise must not entail retail/wholesale sales on the premises. If any sale of goods takes place, it must be done at an off-site location or be a transaction in which goods are shipped directly to customers from the manufacturer or warehouse distribution center.

I agree to have no sales at my residence (the location stated for the home occupation permit) and will not advertise with window signs, display of goods or other methods that I am conducting a home enterprise.

5.An approval may not be issued for businesses which require use of more than one vehicle larger than a 3/4 ton truck or a commercial delivery vehicle. Reasonable courier services are permitted to or from the premise. If your business entails delivery or shipment of goods to your residence, please describe the frequency of the shipments/delivery, the nature of the goods being shipped and where the goods will be stored.

6.If you have a secondary vehicle that you use for your business enterprise in addition to your own personal vehicle, please identifiy the year, make and model of such a vehicle and describe where this vehicle will be parked.

7.The home enterprise shall not change the fire safety or occupancy classification of the premises.  Please list all materials, equipment or activities, which may involve hazardous materials.

I understand it is my responsibility to check with the Santa Monica Fire Department (Hazardous Materials Division) (310) 458-8915 to determine if any change to the fire classification would occur with the establishement of the home business or items stored in the residence as part of the business.

8.The home enterprise must not cause hazards or nuisances to the premises or neighborhood. I agree that the home occupation will not be a source of annoyance by creating noise, dust, vibrations, odors, smoke, glare, electrical interference, or other hazards.

9.The home enterprise establishes for those who use the premises as their place of residence, a home business office. It is not intended for persons other than those that reside on site to work at the premises.

I agree that no persons other than myself and those who physically reside on the premises (the location stated for the home occupation permit) will work, gather or congregate on the premises in connection with the operation or practice of the business. I will have no employees work at the premises other than household domestic staff or childcare providers.

10.All goods, articles and materials, except for samples, will be received, stored and sold directly to customers at an off-site location. If the nature of the home interprise involves the production of a product, please describe the product and the volume of production.



11.Will this product involve the storage of material or mechanical equipment not recognized as being part of a normal household or hobby use?


12.The premises will be maintained as a residence; excessive or unsightly storage of materials or supplies within the premises, accessory building or out of doors is not permitted.

13.The home occupation will not generate pedestrian or vehicular traffic beyond that ordinarily generated in the residential district in which it is located.

14.The home occupation will not result in excess use of utilities and public facilities in amounts greater than normally provided for residential use.

15.The home occupation permit shall be valid only for the person(s) to whom it is issued and shall be void when the person(s) moves from the dwelling unit or discontinues the business. (You must apply for a new permit if you change residence within the City of Santa Monica and wish to continue to operate a business).

I hereby certify under penalty of perjury that this information is true and correct. I agree to conduct the Home Occupation in conformity with the Municipal Code (section 9.04.20.04) as stated in response to the above questions. This home occupation must be in conjunction with a valid business license obtained through the City of Santa Monica Business License Division.
