3.                  PUBLIC HEARINGS: Continued Hearings

 

3-A.     Variance 04-008, 869 Woodacres Road.  The applicant requests approval of a variance to allow the construction of a 700 square foot second story addition to an existing single family residence. The addition would be located 15 feet from the eastern side property line instead of the required 31 feet.  Pursuant to SMMC Section 9.04.20.10.030, the applicant may request a variance to allow the modification of yard setbacks on non-rectilinear parcels. The subject property is irregularly shaped and therefore meets the applicability requirements to request a variance. Consideration of this application was continued at the applicant’s request from the August 10, 2004 hearing. [Planner: Bruce Leach] APPLICANT:  Daren Laureano.  PROPERTY OWNER:  Jeff Wilson.

 

3-B.     VARIANCE 04-012, 636 Ashland Avenue. The applicant requests variance approval to allow an additional story to an existing residential structure in the Ocean Park (OP2) District.  The overall height of the proposed addition will not exceed the height limit for the district. Pursuant to the Santa Monica Municipal Code, the applicant may request a variance to allow an additional story which would otherwise not be permitted for an existing residential structure provided certain criteria are met including an existing first floor level that is more than three feet above theoretical grade [SMMC 9.04.20.10.030(k)(1-5)].  The subject property has a first floor line which is 4.5 - 6.5 feet above theoretical grade. Consideration of this application was continued from the November 9, 2004 Zoning Administrator hearing. The applicant has made revisions to the project in response to the Zoning Administrator’s comments at that hearing. 3-C.     VARIANCE 04-013, 2448 Fourth Street. The applicant requests variance approval to encroach 10-feet into the required 15-foot rear yard setback in the Ocean Park (OP2) zoning District.  The existing structure on the property is listed as 5D1 on the City’s Historic Resources Inventory as a contributor to a potential historic district. The variance is in conjunction with the development of an additional unit proposed at the rear of the property.  Pursuant to the Santa Monica Municipal Code, the applicant may request a variance to allow the modification of required yard setbacks when the parcel has a grade differential of twelve and one-half feet or more per SMMC 9.04.20.10.030(d)(3).  The subject property has a grade differential of 12.7 feet from front to rear parcel lines. Consideration of this application was continued from the November 9, 2004 Zoning Administrator hearing. The applicant has made the following project revisions: (1) lowered building height which eliminates previous height variance request; and (2) increased rearyard setack at second story and loft levels.  [Planner: Gina Szilak] APPLICANT:  Peter Schechter.  PROPERTY OWNER:  Dominic Gomez .

 

4.         PUBLIC HEARING:

 

4-A.     Variance 04-015, 1309 Arizona Avenue. The applicant requests approval to construct an eight (8) foot fence in the front yard setback, extend a kitchen addition to within thirteen (13) feet of the front yard property line, exceed allowable parcel coverage, and replace an existing non-conforming awning in the required frontyard setback. Pursuant to SMMC Section 9.04.20.10.030(d)(1), the applicant may request a variance to allow the modification of yard setbacks and parcel coverage on parcels having a depth of ninety feet or less or a width of thirty-nine feet or less.  The subject parcel has a lot depth of 50 feet and a lot width of 50 feet.  Pursuant to SMMC Section 9.04.20.10.030(c), the applicant may request a variance to allow the modification of fence heights.  And pursuant to SMMC 9.04.20.10.030(l), the applicant may request a variance to allow the replacement of features that provide shelter and which are located at the exterior of the building such as an awning. 5.         ADJOURNMENT

 

  ZONING ADMINISTRATOR HEARING POLICIES

 

Any person wishing to address the Zoning Administrator on any of the regularly scheduled items should fill out and submit a request to speak form (“chit”), which is located at the Clerk’s desk at the front of the Council Chambers. Members of the public are permitted to speak for three (3) minutes.

 

A decision on the Zoning Administrator request(s) will not be rendered during the public hearing.  Following the public hearing, the Zoning Administrator shall prepare a written decision to approve or deny the request(s).  A copy of the written determination shall be made available to all persons that submitted a request to speak form during the public hearing or wrote a letter regarding the variance(s). Copies of determinations are also available on the City’s website: www.santa-monica.org Go to Government/Planning and Community Development/Zoning Administrator.

 

All decisions of the Zoning Administrator are appealable to the Planning Commission during a fourteen (14) calendar day appeal period following the decision date.  Appeal forms are available at the City Planning Public Counter.  The appeal filing fee is $211.96.
