Tenants Not in
Occupancy
The court ruled in
early February that the Rent Control Board may again
decide cases where the owner alleges the tenant does not
live in their rent controlled unit. The Rent
Control Board amended the tenant not in occupancy
regulation (Regulation 3304) in January 2004 to address
the court’s concerns.
